So I have that situation occurring now.
Toyota won’t cover my transmission but have no evidence of the supercharger causing the Transmission failing die to supercharger.

    Should I lawyer up?

I'm not a lawyer, but the dealer and Toyota probably have lawyers on staff. Does Texas lemon law apply to a used vehicle?

Texas lemon law covers any substantial defect reported within the warranty period. Assuming you bought the vehicle new. It’d be interesting to understand how a mod impacts a state lemon law.

So you’re trying to get toyota to fix your transmission after you modified your powerplant to deliver more power and torque than your stock transmission was capable of handling?

i dont think I’ve heard of anyone with a stock 2GR thats blown their transmission up.

You should not, because you'd spend a lot on legal fees with nothing to show for it. It can be reasonably shown that a non-Toyota modification that increases engine power will increase the load on the transmission. Your supercharger also came with a tune, right? The tune controls shift logic and torque converter lockup algorithm, which can directly damage the transmission if not coded well. Remember this isn't a criminal trial. Toyota doesn't need to prove beyond a reasonable doubt.

You can have an initial consultation with a lawyer and ask. Assuming the lawyer even takes your case, he'd likely need a retainer up front. Are you ready to throw $1000 cash at the problem with 80% chance of losing it?

Im trying to avoid legal action. I just want my truck fixed. Even the dealership wants to fix it. Its the warranty people who are saying no and who don’t know hardly anything about it. They tried to say something about the intake manifold sensor but with Magnuson it’s common for that code to show because it simply isn't plugged in.

I did ask if they could provide proof that the supercharger had any cause to it. They cannot prove it at all.

    Ive read all
over the place that it doesn’t void the warranty unless proven to be the contributor to transmission failure.

In regards to lemon I purchased it at a ford dealership ship with 40K miles on it drove it until 58K when I started to have transmission slips. I took it to one dealership where they replaced recall fuel pump and then said it drives perfectly fine. I went to another one and they stated that the transmission was gone. Everything was fine until the popped the hood.

I even had Toyota at one point agreeing with me that they should cover it. Then after calling them back I had a different person take my file and then they retreated on it and said they were not going to even after I stated there was no proof of supercharger causing it.

As responded to above, they don't need a smoking gun that the supercharger broke it. And it doesn't matter how many websites say it doesn't void the warranty.

Right now, Toyota is saying they will not fix it. It doesn't matter who anyone or anything says. They are saying no. There is no magic button or secret phrase that will get them to change their mind.

What you need now is to force them to change their mind. Maybe this means lawyering them up and taking them to court where your $1000 lawyer will go up against their million dollar corporate legal team. Maybe it means incessantly calling the corporate number every 30 minutes or basically living at the dealership either screaming, begging, or persuading them. Or somehow trying to convince your local news station that this is breaking news story and try to put them on blast although anyone with a mild knowledge of cars will say, "you're surprised that they won't warranty a blown transmission.... on a used truck....with a supercharger???"

Basically, 99% chance Toyota won't be paying for that transmission. Good luck

I don't know how else to tell you that, if you want the transmission fixed, it will be on you. You put the supercharger on the truck. When you did that, it instantly voided all your driveline. However, it did not void your warranty on rust or radio or something. That is what MM Act does. Keeps the OEM from voiding warranty on unrelated items.
In other words, you are fucked.

So how did they come to the conclusion it was supercharged if there was no evidence of a supercharger?
