If this happened in MD doesn't matter she rear-ended you she failed to avoid an accident. Wish you the best of luck and a speedy recovery. Also be very careful what you post as it can be used against you. Which is why I was very tight lipped until his insurance was like okay it was our clients fault.

Let me rephrase this as I'm not an attorney, it SHOULD not matter if you were actually stopped or not. You can stop for animals crossing the road and you SHOULD NOT be at fault if someone rearends you in MD.

Yikes, hope everythihng is ok, Brian.

i actually slid sideways down a hill into the tree and caught the tree mid slider, with no damage. unfortunately the only way to go was forward. the tree slid along the slider no problem, but was just small enough to fit betweent he slider and tire, after the slider ended.

I agree doesnt matter if you were stopped or driving, she has a duty to maintain her speed and control of her vehicle and avoid an accident. Unless you did not have brake lights this should be her fault.

Dont let that truck go anywhere, until u get paid what it is worth. Not ur fault means ins.co must pay, once they take it,they r in the drivers seat, the longer it sits at body shop/impound yard the more they what to pay u,they hate to pay storage fees.Start searching ur local area (C'slist ,local paper etc)for comprable trucks,Insurance will try and give u KBB value,we all know that is not real world ,I have been through it,it sucks.
