I’m not a lawyer but in my mind planned non op would register it as an off highway vehicle which would not require a smog check until the new owner decided to remove the non op status. There’s even a statement on the dmv website regarding non op vehicles that says buyer beware..

    https://www.dmv.ca.gov/portal/drive...s/fast-facts/reporting-vehicle-status-ffvr-1/

I can’t even find any of the actual laws on this just the crap on the dmv website...

PNO does not make a vehicle an OHV, you have to pay a title fee to change your vehicle to an OHV and then you would be issued a title that states your vehicle is for Off Highway Use only. https://www.dmv.ca.gov/portal/vehic...stration/register-an-off-highway-vehicle-ohv/

The buyer beware is there because you still have to pay registration fees for a PNO vehicle but many people don't care about the POS rusting away behind their trailer and then a buyer will have lots of back fees to pay before they are able to register.

Transfer it to a friend in Arizona or Nevada and have them sell it?

Damn California is insane. I cant believe his only options without risk of lawsuit are the dealership or the junkyard.

It's to keep vehicles that are burning a quart of oil every 40 miles that the owners can't afford to fix off the road. Would you want to sit in traffic next to that truck?

I'd take the money. Sometimes a truck is worth fixing but not a fourteen year old, 2WD, 4-cylinder Regular Cab.

His danger by breaking that law wouldn’t be criminal penalties, just opening himself up to the liability of costs you incur to make it smog legal.

You could negotiate a contract where you buy the rights to the truck and repair it but that’s a lot of work for a truck that’s worth 5k in good condition and needs several thousand in repairs to be road worthy.

For anyone ‘not’ in California, I’d sell the truck for $2000
