My Tacoma was in a wreck: who's fault??

    alright, yeah thanks. So i guess i will know all this for future experiences. although it was a weird situation... technically it is always the person's fault who is turning although the car driving the opposite direction isnt paying attention and is acting strange. but its whatever, ill find out for sure tmrw what the police dpt. says.

    best bet from here on out...is to IMMEDIATELY call the police and have them write a report

    in sc...if youre in city limits city cops will respond...if youre outside city limits...highway responds...typically...

    take lots of pictures...get contact info of witnesses...responding officer will get contact info of other party...

    DO NOT ADMIT FAULT until you are told its your fault by the police

    i should clarify...when the cop asks for your side of the story...tell him the truth...regardless of fault...because he'll prob figure out what happened anyways

    dont worry about that, i wont lie about that situation at all. my conscious would not allow me to BS, im not worried bout fault. just trying to do it the right way and letting the officer that i speak with decide who's fault it is for me.

    So bad news with the police department. They cant do anything bout it now and its between me and the other driver.... UGGHH oh well. I really understand that though. but it does suck. now just waiting to see what my insurance company says.

    1) "You were panicked"? WTF? So what? Get details, pictures, everything you can to CYA!
    2) Do you really think she's gonna pay? I mean, her insurance is too high, they took the van, etc. She's got a sob story for everything. She's going to string you along until you get the cops involved for payment, at which time you're the guy "at fault." Get something in writing. Fast.
    3) Don't bother with a police report by now.
    4) Dude, you pulled in front of her. Your totally at fault. You can't expect to pull in front of traffic and make them stop.

    I really think your only chance is to get her to sign something for payment. At least then, if it ends of going sour, she still promised to pay you. In the contract, don't even mention liablity, who was at fault, etc. just say something like "due to the motor vehicle collision between our cars on XX Date, so-and-so will pay XX dollars to so-and-so in full by PICK-A-DATE." Short, sweet, and make 2 copies. Even better if it can be notarized, but that could make her wise up that you're worried about things.

    Well if the "traffic" was moving when i pulled in i could see how it could be my fault. but oh well even tho she was stopped acting like she was doing paper work or texting... i see your point. And even though at the scene she said she rather pay in cash, thats not the case anymore considering what her husband is saying. like you said i should get it in writing, but that opportunity is long gone. at 18 yrs old i have learned a HUGE lesson on what to do in this situation and i will have the upper hand next time.

    4.56 gears, rear trutrac,DT header, 235/85r16 Duratracs, 2nd filter pulled, inter.wipers, Cruise control, Factory alum. whls/winter tires(2nd set), Afe pro Dry-S , Dumbo eared flaps cut down.
    I had a driver run a red, then try to claim I cut her off, I finally got my money back from arbritration. When you get hit, the other party usually will lie their butts off and yet act in an easy going manner to play you...but not always. I work for the city (Portland), in Oregon you have 72 hr to report an accidnet with dmg over $1000(might have changed). I learned as you did , you dont find the real damage till later.

    Do the report , list witnesses, submit it to insurance and DMV. You may get your money eventually through arbitration,my hunch is you'll be lucky to just have to pay your own deductable.

    I hate accidents, driving , i've been in over 12 in my own vehicle one i was at fault back in "89", the rest werent my fault nor paid. At work in 15 years its around 10, risk management found me "non preventable" in all. Get witnesses ASAP, carry a camera, notify police even if they wont show, they record calls.That has saved me 1/2 my deductable in 2 hit n runs where they never found the other guy.

    I hear ya but i cant do the report for some reason they wouldnt let me. and thats what i am expecting.... to owe the deductible. and who can anyone be the arbitrator? aka the witness which was my passenger? or is that all through the dmv?

    I agree. She was being stupid the way she was acting and not watching what she was doing but you crossed her path which puts you at fault.

    Dude just get the parts and fix it yourself so your insurance doesn't skyrocket.

    Which arm broke, the upper or lower? I have both arms as well as extra spindles if you need that too. Get some local guys together and have a wrenchathon.

    Thats what i would like to do.... its the upper arm, and it cracked and was pushed in about a half an inch. and everything else in that area needs to be replaced. but my parents want it professionally done which i dont blame em. but i did tell them that's exactly what i want to do, to fix it with me and some buddys who know what theyre doin.

    The person turning in from the outside has right of way I believe. You can and should file a police report and opt not to involve the insurance co.

    If this is the case then you’re at fault, I was thinking she was turning out from the gas station. From the way it sounds she may not know you are at fault so I would work it a bit and see if she would pay for the parts and you do your own labor.

    If youre making a left, you are almost always at fault. Its the responsibility of the person turning to do so when safe. Sorry. Hope you are both ok.

    yep, pretty much SOL. if the old lady thought about it she could have filed a report against you if anything. person turning left will usually always be at fault. i had a friend goin 50 in a 25 mph zone, hit a car turning left and she was still at fault.
