Need advice about my wreck

    So on the 24th I got in a wreck. Driving home from working a 12 hour shift, a tire flew over median and hit my truck. I lost control and hit the concrete barrier. Front driver's side tire popped and rim is bent. My drivers side fender is scratched, and the drivers side stabilizer is bent. And my spare which was locked up in my bed flew about 50 yards over my truck and landed on the interstate.

    The police came and gave me a police report case number and told me I could get a copy of the report in a couple of days. Got towed to a body shop and on the way there the tow truck driver said that the wheel came off of another car, but didn't say how or if there was more to the accident. So when I got to the body shop I had to make a claim with my Insurance company USAA. The rep told me that I would have to pay my $500 deductible because they can't prove that the person who's wheel fell off was their own doing. They couldn't control that. (I THINK THATS BULLSHIT)

    Anyway I need to get the police report and see what really went on that day. And let yall know. But I want to know if I really should have to pay my deductible. I've never been in a wreck and am unsure how insurance crap works.... Wouldn't the person who is at fault have to pay for my Damages?? Cause $500 bucks is almost all of my paycheck :mad:

    You gotta pay the deductible in which is the 500 dollars and then Ur insurance pays the rest. I was involved in a accident two weeks ago where a lady hit me. I had to pay twenty dollars to get the police report to find out her information. Come to find out the lady didn't have insurance, no registration, and expired tags. So I had to pay a 250 dollar deductiable and my insurance takes care of the rest. Now if my insurance company go after her and get there money then I'll get my 250 back. If they don't think is worth it. I could go and get it myself. In other words you dont know who the other person is so you can't really do nothing about your 500.

    well supposedly the cop got the other person's info. so thats why I need to get the report and see. And in that case if it was there fault I don't want to pay 500. Especially when I don't have it.

    When the young punk hit my taco, I had to pay my 500 deductable then after it was all over his insurance co gave me a check. Body shop won't release your car with out getting that money.

    I'd think either you get their info and hopefully that means ins info too and go with that or if you don't get any useful info then just say they left the scene and pay half your deductible. That actually happened to me one time but not sure of your policy. Uninsured motorist coverage should work that way I believe, but I'm no expert. Either way, you will most likely end up with a no fault accident on your record for 5 yrs or however long that shit hangs around. Good luck, sucks ass how easy it is for other people to fuck you around and take money out your pocket these days while minding your own business. Complete bullshit. Kinda makes you wanna play the no id, no ins game the illegals play. Why is it that people doing what they are supposed to, going by the rules, are always the ones taking the brunt of what lameasses do. Just totally sucks. Crime doesn't pay is being turned into a bigger lie every day.

    If they found the other motorist, his insurance should cover your truck. If not, I would think this should fall under comprehensive coverage (if the wheel was in the air when it hit your truck and not laying in the road) in which your deductable is typically much lower. I think my comprehensive deductible is $50 so it would depend on how your policy is written. If they do not have the other guy's information, you're sort of SOL...

    How far could have the other vehicle of traveled, assuming he/she is missing a wheel. I would have think they should have been on the other side of highway looking at you.

    the deductible is still 500 unfortunately for my comprehensive....and im gonna try and see if the report is ready today and ill keep yall updated with my battle.

    i couldnt see anyone on the otherside but then again i couldn't really see well enough cause i couldn't get out since i was pinned up against the concrete barrier at rush hour time.....but the cop did say the report will have the other persons info....so i can only hope it was there fault...like i said ill get the report today hopefully and let yall know

    You'll be okay. You did nothing to cause the accident so it's not your fault. When you get the police report just give the info to your ins co and they will go after the other party. The reason they are saying that you have to pay the deductible is because at the time you did not furnish the info of the other party. Once they get that, they know who to go after.

    If they don't have ins, then your uninsured motorists coverage (if you have that) should cover it with no penalty to you. The insurance WILL go after them to recover any monies lost.

    If the other drivers info is on the police report, USAA will go after their insurance. You will still have the pay the deductible if you want it fixed right away. USAA will refund your deductible once the other insurance pays. You can wait if you want but it may take longer than just claiming it through USAA right now.

    Years ago I T-boned an old woman (her fault she pulled out in front of me) and they had to rush her to the hospital so I didn't get her information. I ended up filing with USAA and they totalled my car and I had a check within a week. Two weeks later her insurance company (state farm) calls me and asks when they can come look at my car. I told them it was already totalled and I had a new car, they called USAA and re-imbursed them. Then USAA refunded my deductible.

    USAA is a great insurance company and they will take care of you. I have been with them since I started driving 10 years ago.

    I was in an accident about ten years ago in which a guy turned left as I was going through a green light. Totaled my S-10. He didn't have a license, insurance or tags. I had to pay my deductible of $500 and insurance took care of the rest. Two and a half years later when it finally went to court (I was countersued for negligence), I received a check for my $500 back.

    Good luck and definitely get the police report.

    I have had USAA for about 32 years. Thety are a great company to deal with and are extermely fair. Have used tham for 2 accidents (not my fault) and they took care of everything.

    Get the police report and forward a copy to USAA (If they don't have it). If the other vehicle had insurance, you should not have to pay anything (imho). Call USAA and see what they say. If you are not satisfied, ask to speak to a supervisor.

    You might also mention that you have posted on TW and there are a lot of military people on the board....all waiting to see how USAA handles your claim.

    Again, for me, USAA has been great.

    A lot of times, you have to pay the deductible up front and you'll be reimbursed later after your insurance agent and the other guy's agent talk and come to an agreement on the claim. Anything past the deductible that you paid, your insurance company will cover. And if it ends up being the other guy's fault, THEIR insurance company will cover everything.

    Update.....driver of the vehicle who's tire fell off, was not insured and didn't have a license. Now to send the police report to USAA and see what they have to say.

    Don't you love how that works? You bust your Azz to do the right thing to have what was probably an undocumented person have their wheel fall off and cause you to get into an accident. Do they not know how to tighten a wheel as I had a Honda Accord a few weeks ago have it's wheel fall off while coming toward me on a two lane country road. Luckily I was able to stop in time as the wheel crossed in front of my truck. I stopped to see if they were ok and low and behold they couldn't understand me and I couldn't understand them except "No Policia." Needless to say I called 911 and reported it but I'm a prick like that since the last time I had that happen was when I had a ghetto ass Civic back into me while I was on my motorcycle at a stop sign. They gave me the same wrap but unfortunately for them a Trooper just happened to be passing while I was chewing his ass out and stopped. Now I just don't have tolerance for people who are driving without a license and insurance and most likely stolen tags. Just imagine had that tire jump the lane and went through someones windshield and killed them.
    Glad to see your ok as that could have gone a lot worse.

    It's very common to have to pay your deductible to fix your car until someone is found at fault, then you get it back.

    You can wait, with no ride, until fault is clear and then the other person's insurance will fix your truck or you can use your insurance, and pay the deductible, then you both get reimbursed if fault is found to not be you.

    I was in a wreck three weeks ago when two people behind me both slammed into me. It's been three weeks and their two insurance companies are still arguing. I just keep my receipts and as soon as it's settled I'll get reimbursed.
