Need Advice - New Truck Was Painted Prior to Sale

    ^^^ After a lot of thought, a $1200-$1500 adjustment in my favor that is what I'd consider as a minimum. The difference of $1400 is about what the allowed deduction in a refund is under that section of consumer law where the 3% rule is. It says it can be adjusted by no more than 1/2 of the IRS mileage reimbursement rate (this year its 55c per mile). 4590mi x $0.275 = $1262.

    Still, you all are right - I am taking a hit and I would have been better off financially if I had just purchased this 4x4 off the lot back in September. I'll contact Toyota Motor Sales this morning and explain the updates to see if they can massage that money out of this deal or if they will contribute to it themselves to maintain my confidence that Toyota wants to maintain a lasting relationship with their customers.

    Dude I just noticed this thread. Sorry to hear about your misfortunes, that sucks.
    I bought my truck from Koons the last weekend of August and haven't had any problems with it. You must've found the bad needle in the haystack of good trucks :(

    Ok...I got off the phone w/ Toyota Motor Sales. They said they understand why I shouldn't absorb this $2600 loss. They put me on hold for a while to look at the details of my case and determined that Allen Toyota is where this problem started. They said that the fact they did not disclose this to Koons 'is not standard practice' and that they are the responsible party in this situation. The customer service rep tried to get Allen Toyota on the line but the person I spoke with before was in a meeting. Instead, he left a detailed message with this person and asked that he call me back to work something out.

    I also talked to Koons this morning. They can get the 4x4 Sport to their dealership within a week. I just need to let them know that I'm ready to go forward with this swap. I let them know that I would call them back and let them know if I was able to work something out with Allen Toyota.

    The TMS rep said they were confident that Allen Toyota would step up and get this problem fixed. I still believe the person that transferred this truck told me the truth a few days ago when I asked him about the transfer and disclosure. I hope he was as sincere when he said he would do anything he could to help me out. I don't know if the damages on this truck crossed his mind when he did the transfer, but I do know that if this was transferred within Mississippi he would not have been required to disclose the damages. But it seems to me that not disclosing it when transferring to a dealer in Virginia where the requirements are different was where the mistake was made. I hope that he is willing to do the right thing.

    You are a very stand up guy, reasonable and acting like we all should in this situation. Thinking it was a mistake is being naive imo. There was no "mistake" made. It was intentional. No one did this by accident. Maybe Koons wasn't involved in this as much as you thought, but Allen didn't "forget" to tell Koons. A transfer from Mississippi to Virginia is quite a trek, and it isn't like you walked in and requested the truck. It was on the lot. For what? So the damage would be a non-factor. Nobody in Virginia is looking for hurricane damage. Just wondering if you looked up the damage % on other states around them and you? Maybe Virginia is lax on that and why it ended up there.

    Yeah, but what if Allen sold it at a regional auction within Mississippi? Dealers do that all the time with used stock they can't move. Not sure about new. If that's the case then maybe that's why they didn't have to disclose?

    ^^^ But my point is why? There aren't enough Tacos out there to fill the need imo. So why did it find its way there? And never heard of a "new" vehicle going to auction, only transferred.

    Allen Toyota called back...said they would put $300 (thats three hundred) dollars towards the transaction as a show of good faith. Obviously this isn't going to be over as quick as I had hoped.

    I've called Toyota Motor Sales again and asked to set up an in-person appointment with a regional representative. Again, the TMS rep understood where I was coming from and why I felt I should not take this loss. She said that a regional case manager would call me on Monday. I think I've gone as far as I can go with Allen and Koons. TMS reps have been understanding and as far as I can tell have been honest with me. I'm actually looking forward to talking to them next week.

    So as of right now, this is the best these two dealerships can do to correct this problem;

    $25,647 paid for a hurricane damaged truck.
    -$23,000 trade in value on a truck I've had for 3mo w/ 4589mi.
    $2,647 loss

    $2,647 loss
    -$300 'compensation' from Allen Toyota
    $2,347 loss.

    $27,140 OTD for 2010 Toyota Tacoma 4x4 Sport
    +$2,347 loss
    $29,487 for a 2010 Toyota Tacoma 4x4 Sport

    This includes twice payments of sales tax, processing fees, and destination charges.

    I don't have a problem with the $27,140 OTD for the 4x4 Sport. I have a problem with paying an extra $2,347 to get what I should have gotten in the first place - a new truck with no hurricane damage. That is really what it boils down to and thats what I hope TMS will make right.

    Again, do not accept any loss, not a single penny. If it has to go there, the dealer should trade you the fucked-up Tacoma for a brand new blinged-up Tacoma, FREE OF CHARGE, with their sincere apologizes and Toyota Motor Sales' punishement towards the dealer who started this shit.

    The response I got from the dealer is that the Prerunner V6 6-spd is not available in whatever region VA is in, but it is available in whatever region Mississippi is in. I confirmed it - If you try to build it on Toyota's website you can build it if you enter a MS zip but not a VA zip.

    Believe me, my first response was "Well you got this one here"

    Ok guys this is what I'm thinking. I will sell this truck to Koons. I can't sell a hurricane damaged truck to someone else. Koons sold it, Koons will buy it back. I couldn't sell this without disclosing these damages, and if I did that no dealer or individual would buy it. I have to get rid of this truck.

    If Toyota Motor Sales does something about the loss, I will buy another Toyota. If they do not, I will take the loss and move on. However, I won't be down and out yet. I won't get into details yet. First I need to research whether this action will open me up to a libel suit.

    I'm going out of town for my sister's graduation tomorrow. I won't be on TW until Sunday. Talk to you all then! Until then, keep the ideas coming!

    Yes! Good news! If all goes well, this fiasco will be over by tomorrow.

    I got a call from the regional case manager at Toyota Motor Sales. He reviewed the letters and pictures I had sent them and contacted Koons. He said that TMS 'typically does not get involved in sales issues' but he said he had talked to Koons and they would buy the truck back for what I paid for it, less taxes and fees which comes out to $24,401.

    This could still be considered a loss, but once I consider the value of mileage @ 1/2 the IRS reimbursement per mile, I come out ok.

    I don't know what TMS said or did to get Koons to give me the $24,401. I did tell Debra Latiolais that I would be by with the truck tomorrow. The odd thing is the case manager said that Koons would pay me $24,401 to just turn the truck in to them. If I turned it in towards another Toyota they would only pay me $23,000. I didn't ask why even though it seems backwards. Cutting my ties with this dealership and getting a better number at the same time is a win-win for me.

    After this is done with I plan on stopping by Ourisman Fairfax Toyota and talking to them about a replacement Tacoma. I'm glad I don't have to abandon the brand.

    I'll let you all know how things work out tomorrow.
