Need Advice - New Truck Was Painted Prior to Sale

    Good news! TFS received the payoff check from Koons and it posted this morning. They'll need a few days to process the payment and then I can check to see if there are any overpayments. There should be a $209 overpayment since I made one final payment after the payoff check was sent so that I would not be late for December's payment. They said they received the check on Dec 26th.

    They said that if the check from Koons was a certified check they would send the title immediately and if it was a standard check they would send it out after 11 days. I'm out of town so I can't check the copies of the payoff check I have, but they said I could call back after a few days and check on it.

    This happened to me about 10 years ago on a Nissan product. I noticed it when I got home with it while I was washing.
    This is what I found out with my experience...
    You have 3 days grace period in most states on vehicle purchases. If you find problems within this time frame they are legally obligated to replace or make it right with the customer. A friend of mine says, ALWAYS wash and detail a new vehicle when you first get it home, this is when you will find blemishes. That is why they do a heavy clean up job before you take delivery, they are banking on you taking several days before you wash it.
    As I said, this was at least 10 years ago when you had the opt out through the third day. Laws may have changed since then.

    I still think Akio Toyoda should've delivered that new truck to your door & drove off in the hunk of junk they sold you to make up for the jackassery of their francisee's.

    But as long as your happy with the outcome, I'm glad it worked out for you.

    I agree with you. One of my disappointments is how Toyota Motor Sales distanced themselves from the dealers and didn't really get actively involved until I contacted the case manager. I would think that they would understand that the whole thing reflects poorly on Toyota as a brand.

    A lot of people here have commented that my issues should be with Koons and Allen, and they're right. But when someone hears "I bought a hurricane damaged truck from Koons Tysons Toyota, and they got it from Allen Toyota in Mississippi, and Allen Toyota didn't tell Koons about the damage" I'd bet they walk away with "That guy bought a hurricane damaged Toyota"

    This fiasco is finally over...

    I finally got the check from Koons for $13K today. I've deposited it and will use it to satisfy the downpayment to Ourisman for the '10 Tacoma I have now.

    I'm done with Koons, for good. From here the only things I will do is post a new thread with the VIN and link it in my signature warning future buyers about this truck's condition. This thread on TW is the very first Google result if the VIN is typed in.

    The truck I had was listed on Koons' used car inventory just a few days after I turned it in to them on December 15th. It is no longer there and other auto sites (Yahoo, etc) report that it is sold or no longer available. The listings for this truck in used condition with the 4,652mi it had when I turned it in still show up in searches so this truck was put up for sale after I turned it in.

    It may have been sold at auction, transferred to someone else, or it may be in the hands of another person. In any case, I hope that the vehicle's history was disclosed as it should be. If the honest thing was done then my posting the vehicles history should be a moot point.

    Koons had it up for sale as a used car for over $27K! The sticker price of this truck was $27,247 :p

    Thanks to everyone that read this thread, posted a reply, and most of all thanks to the people that encouraged me to fight this out and not give up.

    May Karma find those responsible...

    Glad to hear. Start the new year out right with a nice new tacoma!

    But I cannot BELIEVE these freaking dealers. Listing used trucks at MSRP NEW prices. And a damaged one, at that! It's too bad you can't personally warn the next guy looking at your truck, kicking the tires. What do you think the chances are he'll end up in tacoma world one day, looking for mod ideas?

    Well he could've left a print out of this tread in the glove compartment, or in a zip lock bag in one of the cargo boxes in the bed. That would've been a nice "time capsule" for someone to find. But after all the BS he's been through, no need to complicate things with those guys when its all coming together, I guess.

    I guess something else you can always do is try & "report" the information to Carfax...maybe send them a link to this thread. That way, at least if it did go to auction, if the next person that goes to buy it pulls a report they'll at least have some history...

    From what I read on Carfax's site, their guarantee is kind of weak. What I understand is its just title guarantee. So if a vehicle has a salvage title and Carfax says its a clean title, they will buy your car back. But if a vehicle has a clean title, and Carfax says its clean, they're clear. They can't help if someone fails to report a vehicle repair or incident.

    Hey atebit,

    At the time I didn't want to do anything that might throw a wrench into me getting my due payment. Check the thread thats linked in my signature. Thats the last thing I'll do for this truck. This thread is the first result in a Google search for the VIN. My last post in this thread will have this signature in it. The linked thread should also show up in a Google search in a little while too since the web address contains the VIN. Maybe it will save someone the disaster I just went through.

    Agreed, I don't blame you for not pushing the envelope after all you've been through.

    I'm a bit of a jackass that way, though & that might've skewed my "risk analysis" of the situation.

    The important thing though is that you got a new, non-torqued truck under terms you're happy with.

    I am very happy that you have a satisfactory and peaceful resolution. I have read this whole post more than once and have been following it for quite a while. The way you handled yourself and the situation is highly commendable. You deserve the right outcome in this case. The pictures in the other post truly show the extent of damage your "new" truck had. My 06 doesn't have a quarter the rust, and I live in a snowy/salted state. I can't express how glad I am that this came to a happy ending, and I wish you the best in the New Year, with your new truck!

    If you go to the Toyota owners online site and register, then put in your VIN, you can see all the work that has been logged by the dealer(s). For instance I had no idea that the roof of my truck had been repainted, but there it was...:(

    Thats very very interesting...I didn't know about this. Sorry to hear that it revealed a problem for you. Hopefully you got some resolution from it? I just registered and Toyota still thinks I have the '09 so I could look at the service history for it. Looks like its been through a lot...emissions inspection, oil change, safety inspection, mechanical inspection, interior and exterior detailing. Last report was on Dec 22nd though.
