I think there's 3 things that have to be proved for medical malpractice, but don't quote me on that. It's been years since my emt/firefighter college course days.

The distinction here is totaling the truck vs fixing what’s damaged. Once it’s totaled unless you have the coverage written in to adjust the settlement your carrier owes market value as does the opposing ins. If you do have coverage written in to account for mods def go through your own carrier and let them subrogate.

There’s more than one way to do it but mine are all valued policy settlements if totaled.

Someone else said it but the avg consumer doesn’t give a **** about your mods when shopping for a grocery getter.

Sorry for your loss. I went through the same thing last August when a young kid ran a red and totaled my ‘03 Tacoma. I had mods on it too. When the insurance company called me they asked what I had added to the truck. They did add up some things like the light bar, coil overs, the shell, and a few other things too. I just had the heads rebuilt 3 months prior to the accident. I spent $3,000 on that. The best he could do for me for the work was $1800. I was happy I got that. All said and done they offered me $18,500 for it & it had 220,000 miles on it. More than I thought I’d get. I think if I ever go though this again, I’ll prob get a lawyer though just to speed up the process.

did you read OP’s post or mine? Other party is at fault. Your response would only be applied if OP was at fault and her own insurance was covering it.

when you hit someone and it’s your fault your responsible for covering what you damaged/destroyed. Aftermarket parts and all.

As Mayhem says in the commercials, "If you pick the wrong insurance company, you might get stuck with paying for this yourself".
    Just kidding.
I got totaled once by an uninsured motorist at fault. My policy's uninsured motorist part just paid for the truck less $500 deductible, plus my medical. I took him to small claims court for my uncovered damages and won.

Be sure to negotiate the current fair market value for a used truck. It is likely higher than you think.

If anything don't be an idiot like me. I contacted my insurance company to increase the coverage value of my truck since I had added about $14K worth of modification. Once they saw I added a supercharger they dropped me. Kinda pissed me off since I know they cover other FI vehicles but refuse to cover mine because it was after market. BS. Anyway I then cancelled all my other insurance with them (homes, autos, life) and moved it all to another company. Which turned out to be a good thing, since I had been with them for over 10 years I didn't realize I was paying way to much. Over all I ended up saving several hundred a year.

last time I had that happen I had it towed back to my house and removed everything I could. Swapped back in what I had then gave it back. They were cool about it. I said your not going to pay me for these and I have the parts you are going to pay out on. I have been thinking about this as well. I am pretty sure my truck will be screwed if it ever happens.

Better take photos of your mods often- and anything else about your vehicle whenever you add to it for records. Also get to the vehicle first- wrecking yard employees helped themselves to the mods in my recovered Westfalia VW before I could once, I was able to see it when they recovered it and went back later with tools to take off stuff like lights and other mods and they were all gone!:annoyed: It felt like a double gut punch being ripped off twice!

Yes & yes. That said what you replied to me here is necessarily incorrect relative to options.

W/o getting too deep into the weeds it depends what a person wants to do &/or what his/her circumstances necessarily are,

If the OP carries liability only insurance (she didn't say but not likely on a vehicle that new) her only option is to deal w/ the at fault drivers insurance company one way or the other. In a perfect world where the opp insurance offers a fair settlement that's the cleanest, quickest, & easiest path to remedy the OP/aggrieved party as a third party claimant.

Any person carrying full coverage has the option of going through his/her own insurance policy for repairs. When the other party's at fault the ins company will subrogate on his/her behalf & if successful the OP can necessarily get her deductible back. There's a lot that goes into making that decision that I'm not going to hash out here but it is an option that might be worth exploring depending on how things go for the OP w/ opp carrier.

All of this is under the assumption that the accident occurred in an at-fault state (most are) & based on the context of the OP I'm assuming it did although she didn't say where.

These conversations are great in a forum like this where there's a higher ratio of peeps with mods to their vehicle b/c it allows those not involved in the accident to learn & make changes to their own insurance they may not know they need to make depending on their circumstances along with helping the OP u/s her options after the fact.

In 50 years of driving I've never negotiated with the other parties insurance company. That's why I have insurance. That applies whether I'm at fault or the other guy is at fault. In fact, I think I've only spoken with the other party's insurer once and that was because we both had the same insurance company, Amica. Amica has no agents, the insured deal directly with the company.

Depends on the state. If it is no fault insurance they deal with their own insurance carrier regardless of fault.

If Amica deals with their auto insureds the same way they do their homeowners I can't fathom doing it any other way unless you have no choice.

I had auto before I bought a house, but have had both for over 40 years. Back when we bought the house, they were very picky about who they would insure. As it happened, my Dad did business with Amica and had a good connection, so they picked up our home owners. Our one major claim was during the winter of 2015. We had a lot of ice and water damage to the house and they covered it fully.
