    Try and see if the PD will take a report just for the record. His Insurance Company may require a Police Report. In the event he does not have Insurance, your Insurance company may require a report as part of your claim. Take it to the Dealership for an estimate. Contact his Insurance Company to file a claim. If you end up having to go with your Insurance Company for repairs, you will most likely have to pay your deductible under Collision. Ask your Insurance Company if you have a waiver for your deductible if it is determined he has no Insurance. If you suffer the deductible you may have to go to Small Claims court to collect your deductible.
    This advice is from a retired Insurance Agent...Good Luck!

    I’ll be taking it to a local body shop that does really nice work so not the dealership or Toyota collision center. How do I establish diminished value of my truck before/after being repaired??

    It's a negotiation between you and the insurance company. Possibly a friend at a car dealership or a repair shop might offer a ball park figure, or just ask your insurance company for a number.
    Regardless of how perfect the repair is, it will have a lower trade in value now.

    Good idea. Keeps your life simple. You'll probably have to pay your deductible. Some States (California) have an option on a policy for uninsured drivers, known here in California as "UMPD". That waives your deductible IF it is determined the other driver has no insurance. If you suffer your deductible your Insurance Company should "Subrogate" to get your deductible back. Sometimes that's like getting blood from a rock.

    Doesn’t really make life easier, actually makes it more difficult for all the reasons you just stated.

    This is basically the easiest possible claim.
    Claimant vehicle parked and unoccupied, struck by insured vehicle. No disputed liability, it’s cut and dry.
    No need to go thru your own carrier, pay for your own rental if you don’t have coverage, or the diff between what your policy covers and the comp vehicle you are entitled to.
    No need to let your carrier have you pay your deductible and wait to get it back from them during subrogation.

    Being a claimant, you’re also not subject to the first party provisions of their policy, or your own.
    I.E. maybe your own policy stipulates lkq and aftermarket parts, and then that’s what you will get. But that doesn’t apply claimants and 3rd party claims.
    There are very few situations when you are not at fault that it is actually more beneficial for you to go thru your own insurance

    This process fucking sucks…I’ve already started a claim with my insurance and they told me they don’t file diminished value claims. I asked about insuring me that any replacement parts written on the estimate by the adjuster are written for Toyota oem parts and they also said they could not guarantee that since my truck is more than 3 years old. I feel like I’m already getting fucked on something that wasn’t my fault.

    But they are ok with putting me in some bullshit rental since my truck while driveable is deemed unsafe to drive since the passenger side door won’t open.

    Getting it fix, and fixed right with new OEM parts would be best. It's not like you can replace a 2017, with a 2022-23 they are not the same truck, it's not like people want TSS, they just live with it. Getting a other used truck ain't going to cut it, you know your truck and have probably maintained it well, and you customized it.

    You could get it fixed, trade for a 22 or 23, if you don't want a truck after it's been repaired. Not that you should have to, and that would still cost you more money.
