    A few things
You are not getting a new truck. I've been through this, just make sure to look at the truck closely when you pick the it up. Make sure they didn't cut any corners and replaced everything that was damaged.

Dont know if they ever use body filler in a tail gate but i would hope they would give u a new tail gate no filler.

If you want a new truck they may offer you a good discount because of what happened, might not hurt to ask.

Filler, contrary to the name it implies, does not "fill" dents as you would think. If used correctly, its only a very light finishing skim coat after the dent has been pulled out

Hey now, Walmart doesn't give me any crap when my new toaster gets broken and I want a new one.

Why should the dealer be any different? /s

If they paint it someone can detect that with a scanner, no matter how nice a job they do. Unless they manage to get the exact same thickness as the rest of the truck or panel, not sure what the actual procedure is. I know this because I recently tried trading a vehicle that had a small dent repaired, about the size of a tennis ball, just popped out and paint repaired. I have a good eye and looking as hard as I could I could see nothing. They went over it with a scanner and came in and asked if I had damage right where the repair was telling me a thickness scanner picked it up. They wanted to deduct $500 from the value. I declined and left then sold privately. I told the buyer about the repair and they had no problem and said they couldn't see anything.

With all that said, I'd make them replace parts and not fix them.

Edit, no you are not going to or should you expect a new truck.

BTW, is it a manual transmission?

If its not major dent to fully need to replace the panel or skin, you wont get a new one unless you pay the difference in labor and parts price. Its quite a bit more expensive to replace a panel than to repair most of the time.

Not to mention the basecoat has to be blended to all surrounding panels if you replaced it. But given its a tailgate and the panel is not directly next to another painted panel, you may be okay if they dont get the shade right, but regardless, point still applies.

What depreciation? No police report = not on insurance = not on carfax = irrelevant to value.

Not entitled to a new truck. However as others have said--I wouldn't settle for a repair. I would expect them to replace all the parts with new OEM.

being so new, and happening at the dealer, it should be replaced with new OEM parts to previous condition. I wouldn't accept anything less. On top of that, try to get as much free service stuff as you can, thats about as much as you can ask for. If anything damaged is repaired to the way it was before with oem parts, and not refurbished, whats the big deal. You should get something for the troubles though.

In state of California Loss of Use and Dimished Value are real things. Have used it successfully many times that it happened to me.

Have to use the bloodsucker 101 lessons we learned in school to the fullest extent.

If accident = Paint and Body work then there is certainly going to be some "premature" depreciation beyond normal miles, wear & tear. New Truck...no.

I would think that this was in their favor, they sold you a new truck and made money off the sale at invoice. The real question is what did you get for the 15?

They will do anything possible to knock money off the trade, that's where they can make the most money.
