    We do assign percentages of fault true. But don't make us out to be money grubbers who will assign fault for silly reasons just to avoid paying. I work in States that have contributory negligence laws. That means, if we find a driver to be even 1% at fault, we deny their claim. I have not once in handling over 10K claims, assigned 1% fault to a driver. If I can't assign at least 10 to 20 percent, then I'm not going to assign any.

    And again, this case is about as clear as you can get for liability other than rear-end accidents. No way the at fault party's insurance adjuster is going to deny the OP's claim.

    I won't debate that, they are few and far between though. If you want to find those kind of claim handlers, look at Geico. I have two claims with them right now in which they assigned my driver 1% negligence. In one, their driver pulled from a stop sign into the path of our driver and claimed our driver had the "last clear chance" to avoid the accident. In the other, their driver backed from a parking spot into the side of our insured in a parking lot as our driver was traveling down the parking aisle. Of course, I will kick their ass in front of an arbitrator... again.

    The good part is that the schnozz of the 2016 is so big it should only be cosmetic stuff that needs to be replaced. I bet if you were driving a Gen 2 with less-pronounced/behemoth grill, you would have not miss the car entirely. ;)

    Agreed. This is ridiculous but very entertaining.

    One more thought the OP should be glad the other driver had insurance! A lot do not. No clue how they get away with that.

    One thing I have learned in my various driving jobs, Right of way does not mean safe of way.

    I strongly believe everyone should be forced to take advanced driver training. Not to be a jerk here, but, had you had advanced driver training, you could have very easily avoided that.

    Damn, that sucks man. Glad you are ok though. Same reason I installed a dash cam in my truck last month. I'm going to have my evidence if anything like this happens to me.

    I was going to ask you if you were in Wichita because I thought I recognized the street. Then I saw the intrust bank sign and was like yep! Yeah people in that town are some of the dumbest drivers I have ever experienced. Zero shits given for anyone else around them. Tough break on the truck man hope it all gets sorted out for you!

    Just was able to watch the video. So after watching it there really wasn't much he could actually do. He attempted to swerve to the right once the red car was clear. Obviously didn't want to go left into oncoming traffic because then the white car would hit him in the side or he would have ran straight into the other car in the turn lane. Well done OP you minimized the amount damage that would have been cause if you wouldn't have done anything.

    Common occurrence here in Virginia Beach. One ahole driver after another. That's why I'm selling my Vmax. Some folks just don't deserve to be behind the wheel of a vehicle....starting with those two cheezbangs! Good work to the OP......

    Ah man, this sucks OP. I'm glad everyone is ok.

    I was in a very very similar accident years ago. Almost identical, except I didn't have any major damage, just a scuff on the corner of my bumper and I think a small crack. The cop told me he was filing it as a no fault for both of us. When I got mad and said the other person was clearly at fault, he agreed but told me something along the lines of: since I was the one who technically ran into the other car, I'm supposed to have control over my vehicle at all times, even if the other person pulled out in front me of me. I have absolutely no knowledge of the actual laws, so I can't comment. I never pursued anything with insurance, and neither did the other person, so not sure how it would have played out.

    I'm not sure how some officers manage to keep their jobs. I once handled a claim for a traffic light accident, both drivers saying they had a green light. Police report comes in and says that my insured had a red light. No witness listed and no mention of how he arrived at his decision. I called him and honest to God, he says to me, "the other driver had the right of way because they were on the larger street". I asked him if he understood the intersection is controlled by a traffic light and he can't assume the color lights based on the sizes of the streets. It was over the phone but I got a Deer In The Headlights silence from him. He refused to change his report. Wow.
