    This guy is exactly correct, although I'm unsure how to pronounce his name :rolleyes:.

    It's an unwind and most likely from a finance deal gone bad. The truck shouldn't have even been in the same lot as new.

    It can be sold as used or demo. However, some states consider it new if it was never registered. At the end of the day, if you want out, you will likely have to pay per mile you have used. It's called "dealer buy back".

    There are no free lunches. Best of luck, keep us posted.

    I’m in the camp of:

    If you are happy with the truck and the vehicle history shows no complaints/ problems - have the dealer refund some money and give an extended warranty. Maybe have them install the lift that you buy with the refund so they can’t deny future warranty claims :). That’s reasonable and you get a heck of a deal on an almost brand new Taco.

    Gotcha. I didn't mean anything by it. Mostly aiming towards if you want them to swap it out for new. I suspect they'll want to undo the deal completely and redo a new deal from scratch.

    I wonder if your contract has any language about this scenario. I've seen it many times, and they usually buy it back, less the miles you have put on it.

    Btw, I just noticed post #10, which may play a role.

    You will have to find out the full back story.

    Don't listen to these chuckleheads who tell you to call a lawyer. You don't need a lawyer right now. Lawyer gonna charge you $500 bucks or more to draft up a letter to send to the dealer which won't accomplish anything you couldnt do by sitting in their office and telling them you want a new car. They don't have much leverage here. You didn't negotiate an especially good deal, either, its not like they HAVE to give you that truck or they lose their shirts.

    Just talk to them and make a simple request. It shouldn't be that hard. If they won't play ball and refuse to give you the correct truck, then maybe it is lawyer time.

    I’m guessing an honest mistake but you shouldn’t be on the hook for it. So the question is what do you want as recompense? You already knew it had 400+ miles and presumably happy with the truck for the week you’ve had it. If so keep it and work out something fair with the dealer.

    Like others are saying, getting the ToyotaCare warranty extended, or an accessory seems like a fair request in return for going back to the dealer redoing paperwork, the unknown of what happened with the truck before you received it, and to alleviate the concern that this was not simply done in error but bad faith.

    I mean they contacted you not out of the goodness of their hearts but likely because DMV said nope. Tell them you want to give the benefit of the doubt but they need to demonstrate good faith in addressing your legitimate concerns about how the truck was misrepresented at the sale.

    2 to 3 miles tops? You're going to be a very unhappy camper always driving around in a "used vehicle". I've never had a car delivered with less than 12 miles and that was my 2008 WRX. Are they air dropping these things to you.

    Stand your ground. If they require that you sign new paperwork then you have some leverage. They told you it’s used by saying “not technically new”. If you like the truck then renegotiate the price and ask for a free extended warranty. Don’t let them corner you, listen to their offer and then report back to us before making any decisions. JK, do sleep on it though.

    Lol. Never cared or had an issue buying/selling a car based on how many owners. This is baseless. How the car is taken care of is how most people assess purchasing cars. You be you.

    I'd shoot for a discount and a free extended warranty if that is the truck you wanted. Odds are its like others have said, financial fell through. Odds are there is not wrong with it if you haven't already noticed something.

    But if you have buyers remorse or wished you got something else/ different color... you just got a get out of jail free card.

    I was a tech at a Lincoln Mercury dealer and we would check the new cars in off the carrier, 1 to 2 miles was very common, anything over that and it's been test driven or used as a loaner by the salesman.
