New Truck Wasn't "New"

    Ive purchased 15 new vehicles in my life .IN MY EXPERIENCE this has been the case .Your results may vary. And off the carrier is different than day of delivery to the customer . I mentioned if you order a truck you will have low miles .If you buy off the lot it is uncommon to have 2-3 miles. IN MY EXPERIENCE .I also don't have 10000 car mega dealers near me either which I'm sure is a huge factor .

    It is not unusual for a "new " vehicle to have miles on it mine had 140 some odd miles on it it came from another state because I wanted a 6 speed and the dealer did not have any. There is not a shot they will put it on a rollback and usually dealer to dealer swaps involve swapping trunks color, options, etc. The problem arizes when they can't regester it as new there is some thing wrong there it is no longer "new". Tell them you want to trade it in right now and see what they offer you.

    Exactly... if the stat was meaningless, then CarFax wouldn’t track it. Worst is buying a “fleet”, aka rental car... so much potential abuse there.

    Off topic but to throw this out a vehicle can be titled as new as long as it has under 500 miles(Pennsylvania) from what I remember.

    If a dealer called me and said we need to change the transaction category from new to used, I’m not sure what I would do.

    Is that what they are asking?

    Dealer figured it out when they did the title work. Deal is bogus so explore your options. Just letting them redo the paperwork to check the used box is the easiest thing for them to make it go away. You've basically gotten a free rental if you decide to walk away from it.

    Learned my lesson here as well. In my situation, I knew the exact truck I wanted and used the largest volume dealer in TN (and apparently one of the highest in the entire SE region) but they didn't have SSM in the package I wanted. I ended up signing paperwork to have a truck driven by a dealership tech from a dealership 200 miles away, when I received it there were almost 400 miles on the truck and was shown history where the truck had been with my selling dealer at one point but was then used as a dealer trade and driven to the dealership 200 miles away, then was driven back to my dealership where I was so excited to get the truck I signed the paper giving consent and took my truck home.

    I had lots of issues with that truck in the first year. Lots. I've worked it all out now after a lot of time money and frustration, but regardless of the reason I will be more patient next time and wait for a new one off the doc that hasn't been test driven to hell nor driven between dealerships.

    Different story than OPs though b/c mine was sold as new and qualified as new as it had never been registered and had clear history of being traded between dealers... I'm to blame 100% for mine

    This may have had zero impact on the quality of the truck I purchased, but the reality is I will NEVER KNOW how the truck was treated those first 400 miles I didn't own it... at least buying it BRAND NEW I know any issues are either a result of me OR initial quality from the factory.

    I think he has a bit of an upper hand. If there is a contract page where it just gives the basics of the deal and it is checked as a new vehicle, that is the binding document. All the other paperwork is just details like financing, power of attorney, etc. that they could change if it was screwed up without much argument. I'm not saying his hand is worth thousands but they should bend a bit to get it solved.

    edit: I would find out what the title situation was. Who and why. My bet is a dealer did title work before financing was funded and it got turned down for some reason. Once it is titled it's used. More of a paperwork used than a truck used other than the 400 miles.

    Under CA law I think they had to offer him a contract cancellation agreement if they sold a used car. Also, whether it was intentional or not, I believe under CA law this is considered fraud. So I think he has a pretty strong hand. There are all kinds of differences in requirements for a used car sale by a dealer that they don't have to do with a new car.

    You guys are getting the OP amped up for a pot of gold at the end of the rainbow that simply isn't going to be there.

    Sure, he'll be able to opt out of the deal, or trade the truck for another one. Since the OP probably likes his truck, and the carfax shows it as new, I'm not sure how either of these are a big win, let alone the financial windfall some here are predicting.
