Turn it in, go to Freeman Toyota in Santa Rosa and get a way better deal on a NEW Tacoma.

Had a guy with a lot of time on his hands picket the BMW dealership two businesses down from me, for a week straight, 8 hours a day. Always wondered if it cost them a single sale.

20 Tacomas might help, though.

Sorry dude. That sucks. I'm sure you were all jazzed up about your new truck then THIS.
It's only got 420 miles and it's probably just as good as new. But, try to get an extended warranty thrown in for free. Maybe a 6 year 100K warranty?
If not return it. There are plenty more Tacomas on the lots. Just get one with 50 miles or less.
    Good Luck!

The dealer stands to lose quite a bit if you cancel the car, I agree with BBP, ask for an extended warrantee for your own piece of mind.

Um what are the 35 reported odometer readings. My truck has 35k on it and I'm the second owner and it had under 10 reported when I bought it with 13k

My "new" Sport had 265 miles on it when I bought it. I liked the truck and after I questioned them about the miles the GM of the dealership (BIG dealership with many brands on the lot) told me the truck had been bought by a women who wrote a rubber check for the full amount. She returned the truck two days later and wanted a bigger truck so she wrote another bad check for the difference on a new F150. Yes, my truck had 265 miles on it and YES I did get a very healthy discount ($5000) and two oil changes added on to the ones Toyota offers. The truck hadn't been titled yet so it was a new truck and I got everything that comes with a new truck plus the big discount, oil changes, and the lifetime engine and drive train warranty that this dealership gives on new vehicles. I was happy and I got EVERYTHING in writing signed by the GM. This is the third new vehicle I have bought at this dealer and I have been happy with the deals and the service I get from them. I guess I'm lucky to have a decent place to do business with. Besides they made $$$ off the 2006 Tacoma that I traded with low miles on it.
I guess my biggest question to them was WHY would you take a check for a $38,000 vehicle without taking five minutes to call the bank and see if the check is good??? Then do it again two days later!!!

That was 35 miles on the truck last time a report was made to carfax.

I would figure with an amount that high it would have to be a certifed bank check, not a personal check. Sounds like the business office needs to be reviewed.

Yes. I'm not the sharpest knife in the drawer, but I would sure make a five minute phone call and do some checking. Oh well, it worked out great on my end. It was the last 2017 they had and with the mileage and history they wanted it gone.

I've stroked personal checks to pay in full for three different vehicles at three different dealerships in Florida and Tennessee. No one batted an eye on any of the three occasions. Don't know if they checked the checks..

Edit: In hindsight, I almost certainly would have made my purchases on weekends. Likely the dealers couldn't have verified funds at all.

I put $3k on a credit card (most dealer would allow, card has great cashback and I pay in full), and a personal check for the other $30k+. No questions or even a hint that they were concerned. The bank was closed so no one to call and verify anyway, unless there is some automated system that would tell them a current balance.

Not sure if they ran it as an e-check, or submitted it for payment the old fashioned way. IIRC, it took a few days to show up, so I'm expecting it wasn't submitted electronically. Clearly the lady that wrote the hot check in the post above had hers processed the old, slow way.

This is correct. To those saying 'lawyer up', what is that cost and what can you reasonably expect to achieve? IOW, when all is said and done, how much can you prove you 'suffered'?
The 2018 truck and color combo I wanted was already gone from my NE area. My salesman did a swap from Philadelphia area, so my truck had 200 miles at delivery. No big effing deal in the long run really.
See what/if the dealer offers you to make it right.

Generally speaking, you violate California's criminal fraud laws anytime you
    1. commit an act that results in an unfair or undeserved benefit for yourself, and/or
    2. cause harm or loss to another person.
Fraudulent acts are most frequently driven by two motives: (1) financial gain, or (2) the desire to escape criminal culpability. That said, there are a substantial number of fraudulent acts that California penalizes...some that are clearly based on these motives and some that are not.

Sorry, but you aren't going to prove fraud if they say it's simply someone's mistake AND they were the one who contacted HIM to alert him and to try to fix it. As it stands now, you won't get a prosecutor to waste his time.

You guys really need to step back and stop giving bad advice and amping him up.
Let's see what the dealer offers first.

When I bought my RX350 in 2016 the one I wanted had 3 miles on it but was at a dealer 41 miles away. The salesman made me sign a permission slip to let them drive it to my dealer and put those miles on it.

You happy with the truck? Keep the truck. The dealership isn’t going to give you thousands of dollars back. Just go redo the paper work and ask for a couple free services on them and call it a day.
