    Biker created the situation but the driver failed to defuse it. They both failed. That’s not a courtroom judgement, just my take on their responsibility.

    Idk. The driver has no obligation to do anything but when the rider turned into him, he tried to stop. Pretty sure no one wants to hit someone.

    Bicyclist must follow same rules of road as cars. If that was a car instead of a bike they I'd think they could be charged with reckless driving and failure to signal a lane change same as if a car cuts in front of you without warning. The truck driver might have partial blame for not properly observing and avoiding a dangerous situation but unless they were speeding I don't think they would get ticketed. Just an opinion.

    All drivers have an obligation to avoid accidents, too few drive to avoid them. Pretty sure the driver was damn well aware of the erratic, poorly controlled cyclist but just ignored him until it was too late. It’s a prime example an accident that could have been avoided. Legally not at fault? Yeah but that’s a low bar.

    I’d argue the driver was avoiding. Right up until the moment he bike was traveling the wrong way. Even then, he tried to avoid hitting the guy.

    Let’s use a different example to test your obligation theory. You’re merging onto the freeway where traffic is traveling at 65 mph. However, you’re only doing 40. If I’m the unlucky victim, do I slam on the brakes and risk getting hit or swerve and risk hitting someone to avoid a collision? Do I pray everyone else takes that same obligation? And btw, unless it says otherwise, yield is the default.

    What you’re arguing is effectively that in any situation every party will avoid a collision. We have rules of the road to clarify how we use the road, who has the right of way, etc. as a user of the road, your obligation is to know and correctly apply those rules.

    Many accidents are the result of failure to yield the right of way. The bicycle fails to yield first when he does not stay to the right as directed by the rules of the road. Second, he is riding in a reckless manner by trying to maintain a wheelie and by riding in a manner that makes it impossible for other users to predict his actions. Finally, he fails to yield by swerving into the truck’s path at the same time he changes direction and was traveling in the wrong direction.

    Driving defensively should give you some time to react and possibly avoid a collision.

    You assume the driver had no time when the cyclist had been riding erratically the entire time. The driver had the entire length of the video to asses the situation and avoid it. The cyclist gets a Darwin Award, the driver wasn’t criminally libel, just oblivious.

    If the person on the freeway is paying attention they won’t have to “slam on the brakes”. Insisting on right of way may absolve you in court but it won’t keep you out of the accident in the first place. Defensive driving is proactive, it seeks to stay out of situations that are escalated by the poor driving of others. Speed up, slow down, or move over to let them in, you have a range of choices that narrows the longer you wait to make one. Right of way won’t keep you out of an accident if you insist on keeping it. It’s supposed to help us organize our interactions on the road and sort out who pays damages but it can’t prevent accidents, that’s up to us.
