    Just don't commit any felonies or violent Class 1 misdemeanors. At the moment the Courts are still holding bond hearings, but that could come to an end soon.

    I asked one judge if he was being more lax with his rulings on bond motions.

    Nope. He said if you deserve to be in jail then you deserve to be in jail Covid19 or no Covid19.

    I agree in principle, keeping in mind two things. First, everyone is innocent until proven guilty (thank you, Fifth and Fourteenth Amendments). Now more than ever, I think the weight of the evidence should be considered in determining bonds. Second, at some point, logistical problems are going to arise. There is a point that we will start running into over-crowding and speedy trial issues if the Courts don't open back up. At that point a decision needs to be made as to whether "we" are going to continue to prioritize the incarceration of non-violent offenders, drug offenders, or those who, if they are to be found guilty, have likely already served what a Judge or Jury would give them.

    Evidence is not weighed during bond hearings. Probable cause already exists and has been demonstrated to the courts satisfaction. The only issue at stake with regard to bond is are they a danger to the community and how likely are they to appear for trial, not guilt or innocence. That determines bond. Second, overcrowding is a non issue. Current jail population is half what it was 10 years ago locally and it was not crowded then. Releasing them on bond does not change the speedy trial aspect. One can make an 8th Amendment argument that for a minor crime the accused will most assuredly serve a sentence well beyond what a reasonable sentence would be if found guilty if held without bond. But really very few are held without bond. Many are held with a bond they can’t pay since those slinging dope don't tend to be the “save money/ build assets” type individuals.

    I will tell you a ton of lawyers are going the “My client is gonna get the Coronas” route asking for lower bond and it is not flying either.

    My point wasn’t to start an argument (shocking for a lawyer - I know), but to point out what I believed were the issues were with that mentality. Some of what you have said I agree with, and some of it I don’t. I can tell we have very different views when it comes to criminal justice, and I probably have a very different view than that Judge you spoke with as well. For now, I think we will just have to “agree to disagree.” Perhaps we can argue over a beer at Cedar Run sometime, ya know, once the “coronas” is over.

    Had to run down to JMU today and on the way checked out Taskers Gap. Pretty muddy after the rain we got last night and today. Only made it about 1/4 mile before I hit a mud pit and decided to turn around since I was by myself and didn't want to chance getting stuck. Don't think it will get better with the forecasted rain this week. Peters Mill is still closed for maintenance.

    Debating a topic over beer is much better than the internet. I would prefer Powers over Cedar Run. much better beer, but will capitulate and go to Cedar Run if you insist. As long as we are not in a group over ten we are fine and don’t need to wait for the Covidiocy to end.
