    When we were hit in my wife’s Rav4 the insurance company told us we were required to either repair the vehicle or use the check towards paying down the car. As the damage wasn’t bad we used it to pay down the car. (Then just decided to pay off the rest after that anyway so next time we won’t have to worry about that). So for those of you saying it’s insurance fraud, I think it only would be an issue if you took the money and used it for something besides paying down the loan or fixing the truck, can’t mod it besides fixing it, or take a vacation on the money.

    You’re following the orders of the insurance company, under consultation with the lien holder if present, so in this particular case you’re doing as instructed. The insurance company will decrease the value of the vehicle and indicate prior damage on their documentation and you won’t get paid out full “clean” value if a total loss occurred.

    That’s the primary difference here and 99.99999% of situations don’t occur this way. Acting as if you’re repairing the vehicle and pocketing the money = insurance fraud.

    It’s in the lien holders name so they can’t just pocket the check (as others have encouraged the OP to do and commit fraud).I can’t grasp the ignorance of some of these forum members that think committing fraud with both the lien holder and their insurance company is somehow a good idea...

    It’s not “textured”, it’s a specific coating that Toyota uses on the bottom panels to prevent rust. They developed this after the multi billion settlement to try to prevent the “rust belt” trucks from getting cancer and it must be specifically applied in accordance with Toyota specs.

    That’s not “careless” that’s an asshole that doesn’t value things because they are an inconsiderate piece of shit!

    This is 100% preventable and I’ve stopped multiple people in parking lots who have done this to other vehicles and attempted to drive away.

    “Hey asshole, that’s hit and run and you’re going to jail if you move that vehicle another inch.” They usually say but but but it’s only a little scratch and it happens all the time... no you fuckwad that’s damaging someone else’s property and your running away because you’re an inconsiderate fucking piece of shit. How about I slam my boot into your drivers door and say “oops, it happens all the time” ...

    I hate what has happened to society, these people have absolutely no consideration for anyone else besides themselves and it’s going to take a serious and major change to make these assholes understand that this type of action isn’t proper or normal in a civilized society.

    My car was hit in Hoover a good while back. Usaa insurance was the insurance company of the at fault driver. Upon taking it to my body shop, I was issued a check in my name, not the lien holders name, but mine. The check was over $4,000. Body shop repaired it then we went on vacation. Insurance fraud is when you lie. I didn’t lie they just overpaid and I accepted since my insurance goes up seemingly every year due to ‘area cost increases’.

    Like it or not I honestly don’t care. My car was hit while I was parked and my family and I weren’t in it. I didn’t fraudulently park there nor fraudulently claim something that didn’t happen. The body shop gave an estimate then did the work and money was leftover. That money helped pay for ridiculous insurance cost increases for a perfect driving record.

    He doesn’t really understand how it works.

    If you are a 3rd party claimant, and the insurance of the person is at fault pays you, they don’t give a shit what you do with the money. They do not have any responsibilities to your Leinholder, nor do they have any liability for what you did with the money, that’s between you and them.
    What he is trying to get across only applies to 1st party claims where a vehicle is financed.

    If you sideswipe a guardrail coming home from happy hour and do 10k worth of damage to your truck that you have a loan on, and your insurance just pays you out, but then you decided you’d rather blow the 10k on hookers and dope than fixing the truck...and then decide a month later that it’s now an ugly truck with all that damage on it so you’re just going to walk away from it and let that bitch get repo’d...the insurance company is on the hook to pay the 10k again for not protecting the interest of the leinholder...bc technically they own that truck untill it’s paid off.

    Full coverage is the term used for the uneducated, to hard to explain it the other way.

    As far as what is required, states only require a minimum liability policy, the loan company or yourself dictate more coverage. And there is a financial limit on what coverage is needed, look at the loan docs.
