    What still enrages me to this day is the following...

    • The prick who hit my truck was arrested for DUI after hitting my truck and it said so in the police report...
    • The aforementioned prick KILLED somebody while driving drunk in the 1980s and did prison time for it...
    • My insurance company deemed the guy to be 100% at fault...

    Sir Drinks-A-Lot told his insurance company I ran a stop sign and they believed him despite overwhelming evidence that he deserved not to pay for everything, but also to have my foot firmly up his ass, and to get his driver's license permanently revoked, so they refused to pay!

    Thanks, I should have been more clear. Collision covers if you are in a collision of any kind. Unless your in the act of committing a crime.

    I had a similar experience with a woman who had Allstate...

    I was stopped a red light in the evening; It was dark out...

    I looked down at the HVAC controls just as the light turned green, and right as I noticed the light was green, this woman in a 2006 Toyota Highlander drove right into the back of me. Her excuse was that she saw the light turn green, she assumed I would be going, and looked down while driving forward, and the next thing she knew she drove into the back of my truck; I'm 99% sure she was texting, but she admitted fault so I didn't push it...

    She wasn't the issue; For $1,200 worth of damage to my truck (new bumper and some minor paintwork), Allstate dragged their ass for about two months. The accident occurred in mid-March of 2015, and I didn't get the truck into the body shop until well into May if I remember correctly; Luckily, the damage was so minor that the body shop took less than a day to fix it!

    There is one more factor though. ALOT of auto insurance policies now have a clause that states that if the insured is operating the vehicle while committing a crime, the policy does not cover damages. It was originally added in there for cases like if someone intentionally wrecks or is running from the cops and Rams a bunch of cars, etc... BUT,. Lawyers being lawyers.... Some 'mudduq' insurance companies now claim that since drinking and driving is a crime, if thier customer was convicted of an OWI at the time of the accident, they were in the process of committing a crime, therefore they don't have to pay. I'm starting to see that more unfortunately :(

    I had thoughts about committing a crime after that accident happened, involving my fist making contact with the drunk old man's mouth...

    The only reason I really let it go is because I was not hurt and my truck was not totaled; But you're telling me if I was hurt in that accident, his insurance company wouldn't have paid my medical bills?!?!

    Here's a story; Thankfully it does not involve an accident...

    A guy I know who is insured with USAA got a DUI; He was arrested and lost his license for like six months, then got it back. Because it was his first DUI, he didn't have to put one those breathalyzer interlock things in his car; What amazed me was that he did not have to fill out an SR-22, and he says his rates were not affected by the DUI on his record.

    If the clause is in the policy, YUP! They could fight that in court. The other side of that, is EVERYONE needs to read thier policies! If you go out to eat and have a glass of wine, you are totally fine to drive, but an idiot on a bike runs a stop sign and you hit them, when the cops show up to a pedestrian/bike accident they always do alcohol test. Even though you were fine to drive, if the test shows you were above the limit, if your insurance company trys to use that clause, guess what? Your stuck paying the idiots medical bills! It happens!

    I think the easier thing to do is not drive drunk, and I've been thinking about an umbrella policy as well...

    It cost insurance companies about $18 to run your MVR report. It cost nothing to run your CLUE report. The MVR shows your ticketed offenses. Your CLUE shows your claim history. Insurance companies don't constantly run MVR reports. So, if he never told them he got the ticket, they probably don't know about it yet. Now, if there was an accident and a claim, they would know about it and run the MVR and find the OWI. On top of that, what some people do when the state requires an SR-22, they don't tell thier insurance company about it by adding the SR-22 to thier primary policy. Instead, it's cheaper to buy a second non-owners policy with no vehicles listed with an SR-22 with another insurance company.

    There have been times when I've been headed home in an Uber, totally hammered, and I've seen some boor bastard getting arrested for DUI, and I'll just start laughing along with my Uber driver...

    One time it was a Kia Soul by the side of the road with a cop car behind it and the presumed driver doing field sobriety tests, and another time it was a Saturn Ion being hauled onto the back of a flatbed (the driver was already in the back of the cop car)...

    Lol, in college I saw my roommate get arrested for an OWI for failing the field sobriety test and he was dead sober, just an uncoordinated bastard, lol! They tested him at the jail and he passed, they still tried to charge him. Luckily he was also working as an intern for a lawyer at the time, so they got it dropped.

    And stories like this are why, even though I respect and support law enforcement, I don't entirely trust them...

    I've never been arrested EVER, but seven years ago I was stopped by the police after someone called them on me for taking pictures with my Nikon SLR; I was am this huge 6-foot tall guy and I wasn't exactly inconspicuous...

    There had been four break-ins, in less than a month, on the very street I was stopped on; Turns out it was some heroin addict...

    I was walking back to my truck after an hour or so of taking pictures, and the next thing I know three cop cars show up and I've four cops including the sergeant of the whole department and a plainclothes detective interrogating me by the side of the road. I was 23 years old and I'd not only never run afoul of the law, but at that point in my life I'd NEVER been stopped by police EVER. I'm just minding my own business, and the next thing I know the sergeant pulls up in his Expedition and asks to see my ID; I also have Aspergers Syndrome so while I outwardly handled the situation well, it more or less traumatized me and freaked me out (three cop cars, four cops, all for a report of a guy with a camera). They let me go after twenty minutes or so, and that incident let to a general disdain for police still, from time to time, persists to this day. I don't have a problem with police in the slightest; I just don't like dealing with them...

    the 'rule of thumb' used to be 10 yrs. Back then the 'rule of thumb' for depreciation was 1/2 value every 5 years.

    Now...YMMV. I never carry it. Over 40 yrs. I'm ahead. I've replaced a few.

    umbrella means covering all your assets.....kinda….I think. I've asked and my agent said 'what'? You're too poor. I do carry a lot of liability though, guess I'm paranoid I'll cause something bad. No I don't drink, laughs.

    The 2013 photography incident and the 2015 drunk driver crash both took place in the same jurisdiction (Doylestown, Pennsylvania); I was about ready to beat the shit out of the drunk old man for hitting my truck prior to the cops showing up (ironically his drunk ass called the cops after we got into an argument about who was at fault), and I "forgave" the police department for the unpleasant 2013 photography incident after they believed my side of the story and arrested the drunk driver...

    I've also gotten my only two traffic tickets in Doylestown (one in May 2017 and one in January 2019), both of which I fought in court and got reduced so I didn't get points on my license or an increase in my insurance premiums.
