Open carry? Where and how? or are you talking about the guy in the vid? If you are talking about that, well okay. If you are talking about some gun toting outlaw effen with a guy with a nickel plated 44 at his side, I'd like to hear the story!

This is kind of an unrealistic request. Is said "Guy with nickel plated 44" going to tell all his buddies how he still got jumped while he was carrying?? Are day-to-day police reports regularly released?? Do lots of criminals publish their exploits?? There is no good data stream to provide the story.

The anecdote that RM posted about the one robbery that open carry has prevent is just that...one story. Anecdotal evidence rarely ever proves anything true or false.

Much like the feeling that cops are all power hungry assholes that gets shouted from the mountain tops when a new "bad cop-no donut" video shows up. There are literally 1000's of normal police actions for every one bad cop video. The good stuff cops do doens't make news or enflame passions...so no one hears about it.

first off all everyone and their mother has the right to bear arms...(i believe even felons do an i know im in the minority but i truly believe in natural rights and if someone cant be trusted with a weapon they should still be in prison for their crimes) no one has to prove anything and by forcefully detaining them and demanding id etc you are forcing someone to incriminate themselves....especially if they are a felon they have a right to remain silent and the right to be free from searches without a warrant unless they are committing a crime etc.....

there are more instances too...i was at McDonald's about a year and a half ago. i got out of my mustang convertible a group of 6 guys stood up from the outside table where they were seated they were basically surrounding me. they never said anything to me and i said nothing to them...but the guys closing in on my left side spotted my openly carried M&P40 full size in a serpa got seriously bug eyed and froze then about half a second looked at the others and they all dispersed......were they trying to commit a crime i honestly do not know but i had a weird vibe from the situation.

i honestly dont think that OC makes you a target because 99% of the population doesnt even notice when i am doing it normally only children who are at eye level notice........ i also think how you carry yourself will make people notice irregardless of whether youre CC or OC...

How is it that between the dispatcher and all the cops present (sounds like 4-5 units) NO ONE knows the damn law? That is pretty disturbing.

Also the guy claims that he had his hands in plain view, but then how did he hit record giving us this tape?

To those who asked yeah the guy had it holstered, the cops are actually asking him about it since it's nicer than what they have.

In any case the cop lost his cool and painted himself into a corner. Once he was that much of a dick about it he was not able to back down.

    Edit:

To those LEOs who told us to mind our business- its our right to watch our own backs. That is one thing we do still have left in this country, the right to hold public servants accountable.

i have a voice recorder and i hit record on it and it would record over 24 hours....but the batteries wont last that long(normally about 14 hours)...i imagine it gets turned on when he puts it in his pocket everyday....

His story is that he hit record upon leaving his Mom's house and that he cut it to the start of the conversation- "Hey Junior".

On listening again I can hear him walking and no shuffling as if he was handling the recorder so maybe I was wrong about that point.

In that case if the gun was visible and his hands were in his pockets then that is more in the guy's favor since he clearly wasn't planning on using the gun.

Having the guy take his hands out of his pockets must have been a bit of a backfire for the cop. Despite following his training, he now made the situation a bit more interesting.

Failure to comply to the orders of a police officer is grounds to be treated like a suspect. That's the only thing this guy did wrong. Now he looks like a troublemaker and hurts the case for open carry instead of helping; I assume that helping was his intent.

That is not what it states.

Open carry is legal in Philly. Don't read a pamphlet, read the actual law.

§ 6108. Carrying firearms on public streets or public property in Philadelphia.

No person shall carry a firearm, rifle or shotgun at any time upon the public streets or upon any public property in a city of the first class unless:

    1. such person is licensed to carry a firearm; or
    2. such person is exempt from licensing under section 6106(b) of this title (relating to firearms not to be carried without a license).

welp, there's not much to say that hasn't already been said, just my opinion:

The carrier: dude should've just done what the officer told him to do. easy as that, and he wouldn't have had to be arrested and hassled any further

The cop: probably shouldn't have started the exchange with his gun pointed at a guy walking down the street like he's doing some target practice. and he probably should at least know why he was doing that, not just act on instinct.

And how sad is it that the men and women in this situation, the ones that we trust to protect us (and I say that with no sarcasm, LEOs definitely deserve respect for what they do for ALL of us), don't know that the guy wasn't doing anything wrong? that's what really bothered me listening to the audio and reading this thread.

In the end, the guy might have been asking for it, as some have pointed out earlier, but that shouldn't really matter....he was open carrying with a permit, and a police officer pointed a gun at him because of that. Seems like everyone was at fault in this one

And I agree with Derek, it really is crazy how far hardcore gun owners will go sometimes

i would generally agree but its not just about guns. its our rights...

go look at the thread about deleware taking peoples basketball hoops.

government is becoming the enemy of the people rather than the protector.

next thing you know it will be illegal to gather together in groups larger than 4 without a permit... (sounds crazy but its like that in many OTHER communist/ socialist countries)

i know but it takes people to be passionate about our rights to be the ones who undergo the turmoil and persecution so the rest of us retain some of our own constitutional rights...
