    Jay, this is great news to hear man. I am glad that she is recovering so quickly considering the initial accident. Just goes to show you the resilience of youth! Hopefully the physical therapy will get her quickly mobile again when it start!

    My dad spoke to a lawyer today. Looks like she wont see a dime for pain and suffering. Its sad. She has great insurance so her medical is all covered 100%, so far as we can see anyways.

    But the guy had minimum state coverage and it gets split between all the kids and has a max as well. The most she could see would maybe be $10k but her insurance, since they are paying everything would most likely take that money.

    The lawyer would not take their case because he said he did not want to put any more hardship on our family since he knows there is just no money to go after. Lawyer did not want to take my parents money. The guy has no assets either to go after.

    But being positive, she is alive and doing well, her medical is all covered. And she has the donation money for things like a new mattress for her back and the other little things she will need.

    So on that note, I want to thank you all again from the bottom of our hearts for the thoughts and donations. They mean so much.

    I don't know how badly that lawyer was interested, but there are still options, IF Naomi's parents wanted to pursue it. For one, I have had friends in accidents similar to this. The MEDICAL insurance company cannot take your settlement. The hospital MIGHT be able to sue for a portion of the settlement, but the MEDICAL insurance company can't. Now obviously I am not a lawyer, but perhaps that lawyer did not see a profit in taking the case, so he just walked away. (Many lawyers will do this and not take ANY money, as it protects them from you coming back later and trying to sue THEM for false information)

    After all THAT is said and done, and the driver's insurance company finally settles with everyone, THEN you are still legally allowed to pursue him in civil court. He may not have anything NOW, but in a good civil case Naomi could be able to gain from him any future money he gets into. I know it seems petty now, but nobody has any idea what the future might bring for her recovery. What if (Heaven forbid) there is a permanent disability she has to deal with? Why should her and her family be the only ones that suffer from it? I promise you that if there are 3 other families that had their kids injured, they won't be sitting idly by.

    In my opinion all of the affected families should get together and file a claim with a SINGLE lawyer (this reduces the legal costs) and split the settlement evenly. Don't argue about who should get what because of this or that situation, because that kind of thing is what gets these cases drawn out for months or years. Don't just say "Well, since it will be hard to get anything, we will just give up and not try to get anything at all." Naomi's family pays the health insurance company to cover Naomi. THAT is what the insurance company is entitled to. If Naomi fell from a tree and had this many injuries, the insurance company couldn't take money from the tree. I would contact the other families and get a second lawyer's opinion. Remember as well, there is a difference between suing for injury, and suing for pain and suffering. Pain and suffering the insurance company just can't touch.

    I've been thru this shit myself. THERE IS a lawyer that will take this and run with it....I guarantee it.

    I'm always fast to say "people will sue for anything and everything and laugh all the way to the bank (the McDonalds coffee incident)....then there's this situation with Naomi AND the other poor kids that getting your dues is 100% legit.

    This asshole will go on and time will pass and he will.......whatever....granted he has to live with the death he caused of his stepchild which is HORRENDOUS and is a lifetime jail sentence in his mind...FOREVER!!!!

    If Naomi and the other children have lifetime injuries then they will suffer forever with problems. Pain and suffering is going to be there so find that lawyer that will lawyer the hell out of this!!!

    I've been thru this (3 car wrecks in 4 months NONE my fault) and still have shoulder and back pain here and there so the pain and suffering will ALWAYS be there no matter what.

    THEN.......yesterday my ex-wifes fiance (I like him, he's cool...she's NOT) but anyways was sitting at a 4 way stop yesterday at 1:00 as He was heading home for lunch. BOOM!:mad::mad: Rear ended at 45 mph by a drunk piece of shit. He's home today sore as hell, going to Doctors and getting an attorney today.

    Some more great news!

    They have her listed as fair condition now and no longer critical.

    She has her back brace on now. They have had her out of bed and sitting in a chair, even standing for a bit! They put a much smaller tube in her trachea now as well. They will start to do small runs where they turn the ventilator off and she runs 100% her own with no kind of assistance.

    She was able to eat some soup last night and sucked down a strawberry smoothie today! They said they may be able to use a plug in her trachea tube to allow her to talk if they can turn the machine off. If not just remove the trachea tube all together soon.

    It is such a relief to be able to take a huge breath and know she is going to be ok. She may have some lingering issues and such, but she is going to be OK. Feels so good to say that. Simply amazing what she has gone through and how she has progressed.
