Here is a scenario that I am faced with on a daily basis.I also want to state that I live in FL. I know the laws for U-turns are different from state to state.I would like to know who do you believe has the right of way. Is it the person making a U-turn that is yielding to oncoming traffic or is it the person who has came to a complete stop and making a right hand turn on to the major highway. ROW2.jpg ROW1.jpg

Right of way in order of "importance"

    1. Traffic currently on highway
    2. People making U turns or Left turns thru the middle division.
    3. People at stops (mailman in picture)

People on the main road (no stop sign) always have the right of way. (Unless it’s an illegal u-turn)

With 3 lanes in the main highway you can merge with traffic if the nearest lane is clear. Then the U-Turn car has to yield to said merger. If only they made cars capable of making a U-turn without taking all 3 lanes to do it.

Interesting point so if there was a accident and the merge vehicle change lanes to the center and collided with the U-turn vehicle in the center lane would the merge vehicle be at fault?

Without video proof and going off of he said/she said I think they are going to lay most blame on the one merging for not yielding and merging safely.

honestly its one of those situations where no one is probably going to be put at fault. both parties could have done something to avoid it.

i would think the uturn would have right of way otherwise since there is no sign and the stop has to yield to any traffic on the road.

If the mail man merged he shouldn't change lanes to the middle until it's safe. The one making the U-turn shouldn't be merging until its safe to do so. They can do this at the same time if both drivers are sensible but the mail man should yield to the U- turn guy if both are merging at the same time and there is no traffic in the main highway.

thats what i was already thinking.. i know ks youre always supposed to turn into the closest lane. for example a left turn and right turn can happen at the same time onto a 2lane road.

Exactly. The problem is people merging think they have the pic of any and all the lanes. We got to share the road people.

They do, my 16 IS350 has incredible u-turn ability, can easily do a single, maybe 1 1/3 lane u-turn. Taco? Yeah you probably know.

The main highway traffic obviously has the right of way. However, both are at fault. The PC for U-turns says you can make a u-turn if it can be done safely without interfering with other traffic. The merging car is "other traffic" for all intents and purposes. Subsequently, the laws of a stop sign say you can't proceed into an intersection until it is safe to do so. The vehicle making the u-turn makes it "unsafe". Essentially, both vehicles must yield to each other. Is say whoever actually hit the other person probably started their turn 2nd and wasn't paying enough attention and should bear the burden of fault, but insurance will likely split it

Side note, police aren't experts in PC. Your best advice would come from an accident attorney and the exact PC verbatim
