    Personally I'd shoot the owner and give the pit to a well deserving person. But since that's illegal.. (stealing the dog and giving it to someone else I mean), I guess filing charges works in a pinch.

    unfortunately, pressing charges is the right thing for you to do. This could have been much easier if the owner of the other dog did the right thing to begin with.

    yea that dude is a real douchebag. i hate owners who do this to their pits. this is what gives them such a bad rep. i've always had pits and none of mine every attacked anybody or any other dog for that matter.

    All you gotta do is train 'em properly and show them some love.

    I'm glad your pup is fine; beautiful dog btw. You handled that alot better than I think I would've. I often carry my firearm on me & in a situation like that with little time to think out options I believe there would be a dead pit quickly. A shame, because as others said, not the dogs fault, but who's to know the pit stops with your dog & doesn't jump on you or your gf. I would make sure neither would happen with a well placed bullet. I hope this dick gets what he deserves, but he will probably get a slap on the wrist and continue being the dick he is.

    Ok, for an update...(Sorry bout the delay, we were out of town for a camping trip) We went to press charges and found that the responding officer didn't even give the bastard a ticket for the leash law. Said that he came up to the police station and fed the officer a bunch of BS about how our PUPPY jumped up on his hind legs and attacked at the same time his FULL grown pit attacked. Personally I don't think that the officer even talked with the bastard and fed us a bunch of bullshit! The reason I think this is because the officer got very defensive when my baby said "So a pit attacks our puppy and you don't even give him a ticket?" He said don't tell me how to do my job and ya ya yadi yada ya bs. Only thing we could do was file a complaint about the POS so that it goes on record. I personally hope to run into the shit ass again and teach him some manners on respecting women and other peoples property. Thanks guys for all your input on this matter. Glad to see so many level headed folks on the forum! Thanks to all!

    That guy is a shit stain on the reputation of Law Enforcement. As as not telling him how to do his job...somebody needs to it's obvious he doesn't know how to do it. C the local prosecutor or the District Attorney and see if you can still file charges....

    Preface...do not get defensive as I'm not intentionally taking the other side...but it may come across that way...

    Now then...a question or 2

    At what point should a LEO believe your side over the other guys?

    You said yourself there were no injuries to your dog right?

    Officer didn't witness the "attack" correct?

    Many states...ticketable crimes must be witnessed by the officer...a ticket is considered a charging document and is signed by an affiant who witnessed the criminal act...if the officer didn't witness the dog off the leash in an area where it should've been and had no hard evidence showing such...he cant very well just charge the guy with a crime

    Does it suck sometimes? absolutely...but when the evidence isn't there...and we only have the 2 opposing sides of the story...theres not always a determination that makes the innocent party happy

    one side of a story is not always enough probable cause

    Had your dog sustained some sort of injury...or you had video of the incident...that may have changed some things
