Questions about Frame Rust Settlement

    So I think I might have made a big mistake. Looking for some insight. I just recently bought a 2006 Tacoma TRD V6 Manual Transmission. Small dealership in MA. I did take a look at the frame and saw some rust starting and a small amount of rot. After talking with my co-worked who has the same year I was aware of the up coming settlement, figured it wouldn't be an issue. I wish I did more research at the time. Anyways just got back from Toyota. They said it needs to be replaced and would not pass inspection. I talked with the service manager about when I purchased the truck and it didn't seem to be an issue that it was after 12/2/16 and that they would be intouch after corporate gives the go ahead. My question is should I wait it out and risk driving the truck, or pursue another route to get rid of it? Here are some pictures of the truck and frame.
