Hey guys, I have a 2010 Sport with almost 100k miles. The dealership I bought the truck from included a lifetime power train warranty.

Well, the time has come, and I need to use it as my driveshaft needs replacing. Now the warranty provider (Wascor, I think?) is wanting to deny the claim and void the warranty because I can't produce receipts for every single line on the Tacoma Maintenance schedule. As in, "Oh sir, you didn't send us a receipt for your cabin air filter at 30k miles."

Is this legal? Can the really deny my claim for a new driveshaft because they think I didn't change an air filter?

The contract does that that all maintenance must be done and I may be required to show proof. But it still seems ridiculous/illegal/a big scam.

    Anyone have any input?

I would get a lawyer involved. Sounds sketchy to me.

    Yes, I have some input:

You agreed to these terms when you signed the contract, Yes?

    Time to man up.

The factory warranty and extended warranties are two entirely different things.

Extended warranties that are serviced by a third party, you are 100% at the mercy of the carrier. I bought one on my '03 Tundra, and after getting home I discovered that it was not a Toyota warranty. Not only that, but all service had to be performed at this little independent tire shop in a city about 40 miles from me. I beat feet back to the dealership and refunded that worthless POS.

Good luck, but if you can not provide proof that all maintenance was done, they've got you. It's not going to be worth the $150/hr with an attorney ($300/hr if it goes to court.)

this is why you do not buy into extended warranties.

I do find it odd that you would need the whole drive shaft replaced.... whats wrong with it?

Since you bought this truck from this dealership, and they sold you that warranty, they are the key in getting this covered. Get with the service manager, get with the sales manager, make some noise with the dealership as they have back lines to the warranty company. Don't leave this at the service advisor level.

    Thanks for all the input.

The good news is I didn't pay for the warranty, it's a warranty included with every new car purchased from this particular dealership.

I understand what the contract stated and I'm definitely not going as far as taking this to court. I know there are warranty laws that protect the consumer from being denied coverage because of aftermarket parts, and require the warranty company to prove that the aftermarket part/work caused the issue.
I figured there might be something similar based on my situation- That they should have to prove that my "lack of" changing an air filter cause my driveshaft to go bad.
I have a call with a supervisor this morning so we will see how it goes. I will be sure to update the thread.

As far as the driveshaft, I'm having a severe vibration while accelerating from about 5-40mph. I knew it was driveshaft related based on Internet searches and TSBs for my model Tacoma. I guess the problem is too severe to fix and the shaft must be replaced.

ANother reason why dealer extended warranties are suspect. I see adds all the time for lifetime power train warranty on new sales, etc. etc. Then come the details.... The dealer pays a few bucks to the third party warranty co. and then forces you to fight for the coverage. If the dealer were really honest on warranties like this, they should verify and fight for the warranty. But they're not...

Another approach to the dealer....long shot that it is...

Tell the dealer you want him to honor the warranty under a Toyota VSP.
If you bought it there, and had appropriate maintenance done which could affect the part (probably only oil changes and zerk fitting lube, with maybe general inspections would apply). You could have qualified for a 8/125 toyota VSP for powertrain coverage-then there wouldn't be an issue.

Yeah, they'll laugh, but put it forth as a good-will issue. The dealer may not want to put up with a possible bad review....

    Not in this case.

The Magnusson-Moss Consumer Protection Act only covers factory/manufacturer's warranties. It does not cover aftermarket warranties of any type, regardless of whether the dealer furnished it with the cost rolled into the vehicle or not.

They don't have to prove that anything you did caused the failure... any violation at all of the contract on your part is legal grounds for them to void the whole thing.

you are probably boned unless you can produce receipts that the zerks have been greased at the stated intervals in the maintenance manual

Dealers give these things away because either people pay through the nose to meet the maintenance requirements or they do not and the dealer does not have to cover repairs. It is a selling point and a win-win for dealers. If I was offerred one I would negotiate price down without it.

I learned on that Tundra to make sure that any extended "warranty" that I purchase is from the manufacturer's representative and not a 3rd party.

Is this the warranty you are speaking of? The dealership I bought my truck from offers this one, but you must do everything they state for it to be in effect. Many of the dealerships offer this warranty.

    Lifetime Warranty

    Frequently Asked Questions

    1. WHICH VEHICLES COME WITH THE LIFETIME WARRANTY?
The warranty applies to all new Olathe Toyota vehicles. It also applies to select pre-owned vehicles from Toyota, Scion, Honda, Subaru, Nissan, Mitsubishi, Hyundai, Isuzu, Mazda, and Suzuki, that are 5 years or newer with less than 50,000 miles, and have passed our 160 point inspection.

    2. WHAT IS COVERED UNDER THE LIFETIME WARRANTY? (Non-Factory Limited Warranty) The components covered are exactly the same as the manufacturer's
powertrain warranty, but we extend the warranty for as long as you own the car.

    3. HOW LONG IS THE LIFETIME WARRANTY REALLY GOOD FOR?
The warranty is valid for as long as the original owner owns the vehicle - for unlimited time and unlimited miles.

    4. HOW MUCH WILL IT COST?
Zero. The Lifetime Warranty (Non-Factory Limited Warranty) comes standard with every vehicle meeting the above criteria. The warranty applies no matter how the vehicle is obtained whether it is bought with cash, financed, or leased.

    5. IS THERE ANY EXTRA MAINTENANCE REQUIRED TO MAINTAIN THE WARRANTY?
No extra maintenance is required. You must simply follow the scheduled
maintenance as recommended by the owner's manual.

    6. DO I HAVE TO HAVE ALL OF MY SERVICE COMPLETED AT OLATHE TOYOTA?
Our award winning service department will certainly exceed your expectations and maintain your records electronically. However you are not required to have your service done at our dealership. To maintain the warranty program though, you must provide copies of your service records if warranty service work is to be done elsewhere.

    7. WHERE AM I COVERED BY THIS WARRANTY?
The Lifetime Warranty (Non-Factory Limited Warranty) applies anywhere in the United States and Canada. Good at Participating Dealers.

    8. IS THE WARRANTY TRANSFERABLE IF I SELL THE VEHICLE?
No, the Warranty is good only as long as you own the vehicle.

    9. WHAT'S THE CATCH?
There are no catches, hidden fees, or gimmicks. Olathe Toyota provides this product as an added value to our customers for doing business with us.

As you indicated, it's something that didn't cost you anything and you got what you paid for. If the dealer won't help, you fell into the same trap alot of us have; "and it also has a lifetime warranty on the drive train so anything that goes wrong...." blah, blah
WRT the fix, let us know if you were correct about the diagnosis. 100k seem a little short for drive shaft total replacement, such that it cannot be repaired. New u-joints and maybe you're back in business ????
