I haven't read what every one else said, but this is exactly how it should go. You should get the cost, what you paid put towards a new vehicle. If it's lemoned check your state laws, but you shouldn't be out anything.

Any lawyer is going to be more than $200.
Also EVERY time you go the LAW(yer) way, it will stay in your record forever and never know when you want to buy a new car, house, get a loan, look for a job, etc and and people may look at you as the "sue me" type.
Look at the trucks in the lot and get the best one it catches your eye. Ask to drive it a bit and listen how it sound and feels. Get it.

If it is truly only 200 difference, then I would do it for the newer truck, warrantee and knowing it didn't have all the other shit wrong with it. Will the new one have issues, who knows but your being treated fair and my guess is the dealership is saving yota from a lemon. I bet you could push for even out the door and get it. Get it in writing and you want a loaner until your truck gets in.

I'd tell them you'll do the deal if there is absolutely no money coming out of your pocket. Why should you have to pay $200? Fuck taxes. They need to pay that.

As much as I agree with ya, to drive a new truck for a year then get another new for 200 bucks, isn't that bad a deal here. But as I type this, what happened to the years worth of payments?

I guess I look at it as he wouldn't be searching for a new truck if his didn't have all of these issues. He should be made whole at no cost to him. So while technically it would be a new truck, there's definitely some extenuating circumstances.

I would want a swap, he drives off with new 17 exactly like his and only had to pay what's left on his original loan. Yota keeps the 16, gets to fix it up and sell it as a certified used and save themselves from what they think is a possible lemon.

You need to find out the difference you will owe between your trade-in and the new truck. Don't discuss any loan terms with the dealer. Once you get that number, you can figure it out from there.

Please cite your source for this claim.

I'm particularly interested in examples of where someone's had an actual negative consequence.

Truth be told it sounds like BS and doesn't align with my experience with lawyers, property buying, obtaining loans, or even when I've hired people.

There has been no design change to the AT right? The issues some are having appears to be due to faulty valve body design or other design issue. The TSB has software tweaks in order to try and mask the issue, and seems a crap shoot whether it works for people.

I think hoping the 17 doesn't have this issue is playing roulette. You are just playing the odds on the same distribution of trucks.

If the new one was an MT, I think you'd be on to something.

The stuff you don't know won't hurt you.
People's life get affected by a stupid post on FB and not by a recorded court case?
Two of my neighbors went for Gov jobs and each time a dude came to check on reference one of the questions was "...was he ever involved in any court case you know of?..."

That's fair. There's no way I'd be willing to pay a dime out of pocket in the OP's situation.

I just got a call from Toyota. I am next to speechless at this point. I was informed that rats had nested in my engine and ate through several harnesses. I live in a big city and, while I realize rats are everywhere, I park in the driveway like almost every other neighbor on the street because I didn't even think this was a likely possibility. I drive daily except maybe on Sunday. I cannot believe this happened. Maybe my house is infested and I just haven't seen signs? Obviously the damage is not covered by warranty. The bill is $850. Head is spinning...

Also signs that rats have been in the 2016 Rav 4 engine area - acorns and feces residue...

First rule of the internet, don't believe everything you read. Second rule, apply a bit of critical thinking and basic logic to stuff.

Yes, companies will look at FB and social media to get a sense of who you are. Hiring decisions can and will be made on that basis. The wise person stays away from doing stupid stuff on social media.

Security clearances will ask that kind of question of friends and neighbors, typically just to ensure any litigation has been settled and is no longer open.

Taking those two tidbits and then advising someone not to even consult with an attorney, or exercise their rights within the court system to seek redress?

To be blunt, that's really shitty advice and is founded on nothing.

Just my opinion. Do with it what you will.

That is not uncommon in many new vehicles there was just a thread about this earlier today. The Environmental nutjobs have forced Soy based insulation on wiring so it becomes a meal for rodents.

I'm not understanding what exactly your grounds for a possible lemon are...The truck had transmission issues that were or were not addressed by the TSB update covered under warranty?

Am I understanding the only other issue is the 1st gear and stalling incident due to the mice not covered under warranty?

That $200 deal sounds too good to be true. I'd trade in a heartbeat for a '17 for only a one time $200 payment...(I'd probably get a little nicer and just pay that difference though once I got the $200 deal)....Be careful with any dealership.

I took it in and the original TSB was done which resolved some but not all of the issues. The TSB rev1 was then done on the vehicle and it worked great. The total time it was in the shop was 23 days while they tinkered with things and contemplated changing the transmission. Then this engine issue happened which I did not know was because of rats at the time. Obviously the deal is presumably off. I did not get the chance to call the lemon lawyer, but reading over the Texas website, it does not appear that I would have qualified. Guess I will never know lol.

I have personally spoken to someone else that has a Tundra. He had the same thing happen last week. Rats (or squirrels) ate through his wiring and cost him a 500 dollar deductible. There were partial acorn pieces all on the top of his engine. He sprays Natural Armor Animal Repellent on the engine and the undercarriage weekly now. I am just hoping there is no extensive damage to my girlfriend's Rav 4...
