    Glad your OK man! It sucks that this happened, at least he had insurance. If I were you, even though the insurance companies always want you to bring it to a shop, just say your not sure which shop you are going to use yet and ask for a check. Buy all the parts for 2005-2011 to 2011-2015 front cap, pick a shop, bring your parts, on the tear down if they fund additional damage have them report it to the insurance company for a suplimental payment. They have to pay you for damages, as liling as it's repaired correctly you can use whatever parts or shop that you want to. :)

    I wouldn't let them total it. Just don't accept the offer. The salvage value on these trucks is very high. They may try to run up the damage estimate to total it, so they can get it. I've seen it done! If they do that, get estimates from some very reputable shops to show otherwise.

    Also, If you submit proof of what the same make/model/year have recently sold for in your area that can help raise the value, making it harder for them to declare it a total loss.

    Buying it back is an option, but be warned, depending on the laws in your state, that can lead to alot of future issues. Only one of which is getting full comp/coll insurance coverage.

    Also, depending on what upgrades you have done, they may owe you for them too!

    What insurance company does the guy have and what insurance company are you insured with?

    It depends on the fine print in that particular insurance policy. Almost all states give the company the option to not pay a claim if the damage was caused during an illegal act. Most of the large insurance companies like State Farm and Progressive will pay the claim, then drop the insured.

    Crappy companies like USAA, Geiko, GoAuto, Allstate, Kemper, Fidelity, The General, Safeway, etc.... Will do anything not to pay.

    I deal with this stuff everyday, I'm a licensed Adjuster and Producer.

    Good luck OP, I hope he has a good insurance company, worst comes to worst you may have to make a claim on your insurance. :(

    On a side note, I know none of you guys drink and drive, but if you have a friend or something thinking about doing so, most of the low rent companies mentioned above have added clauses in their policies stating that drinking and driving is classified as a crime, and they will not pay a claim. In other words, if you decide to drink and drive and hit someone, you are stuck with the bill for damages and injuries you caused.

    If you get an attorney, I don't think you need to, but just in case... DO NOT tell the insurance companies, your or his that you have an attorney!!! When and if they need to know, your attorney will tell them. If you mention the word attorney to an adjuster, your screwed. The claim gets handed over to the companies attorneys. Trust me, you don't want that!

    Bring the paperwork for the work that you had done, you can very easily force them to add it on there, if they don't offer to do it a judge will definitely do it.

    Essentially you can make them add this onto the value of your vehicle.

    That literally defeats the point of having insurance.

    Op's insurance would just sue them, and I'm highly sure USAA can bulldoze progressive in court haha!

    I don’t let stuff like that bother me. They should fix the truck up and you’ll be made whole again. You drive yourself crazy thinking about the little things.

    When my family got into a bad accident the car was clearly totalled and we were fortunate to only have minor injuries.
    As the car is going on the tow truck my Mom is like “I just put on new tires” LOL
    Uh mom... IDGAF about your tires XD.

    I’m happy you are OK and hope the truck is fixed without headaches.

    Progressive and USAA work together very closely. Progressive carries out some joint policies with USAA. Especially on motorcycle coverage.

    Just FYI:
    If an uninsured driver hits you that means no insurance.
    A few things can happen depending on state law.
    If there are injuries you can sue the guilty party personally for damages and go after their assets or garnish their wages until the damages are paid.

    If its only property damage and no injuries you typically need to have underinsured/uninsured motorist coverage on your liability policy. Some states may be able to deny coverage if liability is on an uninsured/underinsured party. Your policy will not cover the vehicle.

    Typically what happens is your policy does cover you and your vehicle but you pay your deductibles and your insurance company will sue the liable party and if successful will reumburse your deductible at that time.

    It is critical that you carry uninsured and underinsured motorist coverage. MOST people driving around have either no insurance or drastically low insurance coverage (state minimum).
    Also make sure you have good liability coverage or you’ll have someone coming after your assets and income to cover what your insurance won’t in the event you cause an accident.

    All state laws are different and some states are no fault states so these rules don’t apply.

    I doubt you will have any issues! In many cases, everyone in the same household is actually required to be included on the vehicle’s insurance policy. The only thing I see that Progressive could do is use Permissive which means that if you give another driver permission to take your car, they will be covered by your car’s insurance coverage if not they can legally deny the claim.

    By law when you are legally represented all correspondence has to go through counsel. Its a means of preserving rights, evidence, and correspondence for legal use.
    They legally cannot talk to you if you have a lawyer. Its not them being assholes its the law. Its a good thing not bad.

    I also see it as when you hire a lawyer, you are paying them to deal with this shit for you. Its out of your hands now and they get to talk to your counsel

    oh man! Reading everyone's 2 cents about body repair - here's the big kicker - check your A-pillar and the subsequent paneling. We've totaled out a new GMC Sierra due to an accident like that - and in my opinion, for a 50K+ truck it was repairable... BUT the A-Pillar got shoved in pretty hard which rippled the roof towards the B-pillar ( crew cab ) - and the hours alone via Mitchell system was enough.

    Cool thing is... your air bags didn't seem to deploy which saves this work THOUSANDS!

    If you can tear it down and make the call... anything cracks in the paint would be a good indicator its gone. The plus side you'll probably get close to 20-22K for what you have....

    Something nobody has mentioned. There's uninsured motorist medical and uninsured motorist property damage. 2 very different things.

    Crumple zones are pushed. Cab is shifted. She will be totalled. Had a little moment of silence today. Hopefully I can get what I want off of it. The other person hasn't even talked to their insurance and wont answer their calls.
