    As a person who has lawyered up before, I would only recommend if you have some injuries... Personally someone taking 1/3 for fight for auto body work just doesn't seem worth it... :confused::confused::confused:

    OME and worth every penny.
    I bumped a Taco with My Sienna about 3 yrs. ago. 1K in damage for paint. I apologized profusely and he sued the shit out of me. (1M) The lawyer assigned from progressive said "Never say a word to anyone but us about who's fault anything is" Not cops, not plaintiff, no one. It was a strike against me to have admitted fault.

    Well they admitted liability so now hoping to get something from the payout because I'm in the market for a new vehicle. Cause I've got a kid on the way I was flirting with the idea of a 4 runner

    You are COMPLETELY wrong. I have 2 friends who were hit by drivers insured by USAA. Both of them are insured by Progressive. One of them, USAA is trying to over state damages to total the vehicle. She is disputing it. The other had stopped at a stop light on LA HWY 90, after about a minute sitting there, stopping was rear ended by a person insured by USAA still traveling at 55MPH. Car was completely destroyed! USAA adjuster offered NADA, minus all depreciation. Meaning, the leather seats had creases, not cracks, but not perfect, steering wheel leather had signs of ware, 4 door dings, tires only had 75% life left, you name it. They made the low ball offer. I advised not to take it. But they did! Settlement papers arrived, the agreed settlement amount was over $3,000 less than the agreed upon under payment! I took over since I'm officially there agent. Because they agreed to taking the depreciated amount, I couldn't fix that, but I got the agreed upon amount back plus tax loss.

    After taking a loss on the car... Let's get to injuries. You would think that pretty clean cut. Hurt at the scene, ambulance comes, emergency room... Right? Wrong! Not including missed time at work, pain or anything, strictly actual bills after the accident totalled about $16,000. USAA denied the claim. They were forced to file a claim on there insurance, lawsuit has been filed against USAA.


    I'm contracted with Progressive. For what it's worth, at least from my experience this is what will happen.

    Progressive will pay for damages, usually high NADA, if you argue about valid extras, they have about a $2,000 lee-way, that's about it, and one of two things will happen. if the driver was not listed on the policy, they will recalculate the cost of the driver being included on the policy since the last renewal and give the named insured the option to pay the difference and keep the policy, or just drop the policy.

    In any case man, this sucks. I'm in Louisiana, if it gets down to it and they total it and don't want to compensate you for extras, and try to screw you, if it would help I'll donate a set of OEM 17" and tires if you can get them there.

    Wayyyyy wrong!!!!

    UNDERINSURED/UNINSURED MOTORIST COVERAGE ONLY COVERS BODILY INJURY!

    Comrehensive coverage covers damage to your vehicle, weither it's your fault or not.

    UNDERINSURED/UNINSURED PROPERTY DAMAGE is an optional add on to underinsured/uninsured coverage in the circumstance where you deny Comprehensive coverage but want to be covered not only for bodily injury, but property damage in the case where you are hit by an underinsured/uninsured driver.

    But you are very correct about liability coverage. Most states the minimum required is about $25,000. If you hit a car worth more than that, you pay the rest. Or the other side of it, I got hit by a drunk driver with no job. Policy limits paid out, still shy about $4,000 to cover my total loss 4Runner.

    I know it's the law, man, I'm just giving the 'other side' of it. Meaning, adjusters have lee-way to make judgement calls, or request exceptions, things like that. When YOU say the word ATTORNEY, the claim goes to the attorneys, no more exceptions, no more judgement calls, it's by the black and white on the paper. It doesn't have to be a letter frfrom an attorney to put the insurance company in 'prepare for lawsuit' mode. All it takes is the mention of it. 99% of the time people don't have an attorney, but thet think, oh, if I mention that I have an attorney the insurance company will be scared and pay. The opposite happens! They are less likely to pay, they lawyer up and wait to hear from your attorney!

    Like I said, if you need to, hire an attorney, but NEVER tell the insurance company that you did. Just document, whatever they say, report it to your attorney. If your attorney feels that they need to know he is involved then he will send a letter. Follow?

    Each state handles this type of coverage differently. My policy has a seperate coverage bracket for property damage and then liability injury coverage.
    My comprehensive policy does not cover any damage do to lack of coverage.
    Some states may have this under comprehensive mine does not.

    My comment was focused on how damages are saught afterwords, not in how the policies are written.

    Its important everyone audits their auto policy and looks at how the coverage is stated and the coverage limits.

    Medical expenses are so high now... infividuals really need to carry coverage for them or their passengers.

    In regards to the attorney, yes, never lie you have one. Not a good idea.
    If you must have an attorney they will instruct you to not contact your insurance company. Again when you hire counsel, you are no longer supposed to be contacting them.
    An attorney is required to put insurance companies on notice within a certain amount if time of being retained.

    You're not out that $1600. The paying insurance company has to give you a prorated credit on top of the value of your vehicle if it is totaled out.

    I just went through this. Had a 99 Ranger V6 4x4 about 3 months ago. My brother in law was driving it and was rear ended. It totaled the truck out. Bad news was I just spent $2000 on rebuilding the transmission... and another $1300 on spark plugs, wires, shocks, ball joints, control arms, brake pads, tires etc. All of this was in a 2 month period.

    The insurance offered me $3600 on the truck originally...I declined and sent them all of my receipts for the items that I purchased for the truck and they ended up giving me $5690 as a final settlement.

    It only applies to improvements made to the vehicle in the past year.... It is prorated across that year....and does not include regular maintenance such as oil changes etc.

    Wait on them to offer you a number and then let them know that number does not work for you. Inform them of any improvements made over the last year and send them receipts for it. They will add that value to the original and give you a new number.

    I just talked to toyota about my airbags not deploying. I have a case number and it's going to be looked into. Not looking for a payout but hoping to help others if there needs to be a recall.

    I know there are many circumstances why airbags deploy or not but I'm just playing it safe.

    the dude who got hit and barreled into me was a Mexican with no license. Dude was scared as hell
    and didn't want to get out of the truck. Luckily for me the dude who caused the pile up was at fault
    and had State Farm insurance.

    I had a similar thing happen. My dad was in an accident, I left work asap! Showed up in about 7 minutes, for sure broke some speed laws. Still in a daze... He said man, you know I just spent like $1200 getting the cadilitic converters changed. I was the same... Like who cares, your OK...

    Side note, Nissan Titan, insurance estimated damages at $16,000. Bought it back for. $1500. Completely changed all damaged parts myself. Add paint, total cost $6500.
