Rear ended - worth pursuing action?

    I’d file a claim. They’ll get it from his insurance and should not charge you the deductible. There is zero reason to not file a claim. Your car will be returned to normal with no cost to you.

    heck yes, get it fixed. Take a lot of pictures first. My 2nd gen was rearended, I got it fixed, minor damage. When I went to sell it I showed the new buyer photos of the damage which was minor and he didnt care due to the fact that it was fixed correctly with all Toyota parts. About 2500 ish in damage, due to the parts and painting being really expensive now a days.

    It's important to note that you have zero say in who is determined to be at fault. Your insurance company probably has a policy stating that each company pays for its own insured, and split the fault.

    1. You're right, the driver has zero say who's at fault - the rear bumper does, in conjunction with state law. RCW 46.61.145
    2. I don't know what kind of flim-flam insurance you have, but that's not how my insurance works. And yes, I know (unfortunately).
    3. If law enforcement is involved, their report determines who is at fault in accordance with the law - in this case, RCW 46.61.145. Insurance merely sends an adjuster to assess damage, and they may "interpret" the police report.

    You need to at least call the police and talk to them about it, they will know what is what about this. If it's very minor they may have limits for even filling a report. Talk to the police they have jurisdiction over this!

    I would get it fixed. I backed into a low cement barrier (yes, even with camera and sonar lol) and it must have moved things enough to rub through a wire because the blind spot monitoring system completely fried. Had to get it completely replaced, along with the bumper covers.

    A little something every chance we get.
    Accidents that don't deploy airbags, or result in claimed damages in excess of the parts are just that. Accidents of minimal importance to the vehicle. It got bumped - nothing serious happened - there should be and normally is no "depreciation" of value.

    Yes, I would get it fixed. A kid ran into the back of my daughter last week in a McDonald's drive-tru line as he was texting. Similar thing happened to me at a stoplight about a year ago, again kid texting and not paying attention.
    People need to learn you either drive or text, not both at same time.

    That damage is going to cost more than you probably think, however is't going to be severe enough to cause anyone concern on a CarFax report.

    I'm blown away to read how much confidence you have in your insurance,.

    The police report is evidence, not the verdict in a trial. Only a child believes that what a police officer writes in their notepad is law.

    Also, the law you mention can certainly be used as evidence in a trial or when negotiating a settlement, but that law only applies guidance to a judge or jury if the case is taken to court.

    When you buy insurance, you authorize your insurance company to settle on your behalf period.

    If they determine that your interests are best served by each side paying for their own insured and equal liability that is their decision and you don't have a say in it.

    When no one is injured, this practice is too common.

    1. I am confident in my insurance. I pay good money for it, and they've treated me well in the past. Hoping I never see another side of that.

    2. I didn't say a police report is law or verdict, only that it can reference the applicable laws that were violated, which led to the cause of an accident. Your pompousness precedes you.

    3. You're really just carrying this away from the facts of OP's situation to argue your points. This would be a third-party claim on the other driver's insurance, based on the story I read. No juries, or judges, no settlements, just an honest driver admitting fault.

    4. I'm just curious of your credentials. Are you law enforcement, insurance agent, have a degree in something? I'd like to know the info being hurled at me is coming from a legitimate source.

    It's just a couple of Rachels one in Kansas, Lenexa and one in California, Rancho Cordova haggling it out. If there's injuries it get bumped up to the Karens and Kims. If it gets litigated it goes to the queen mothers

    That is my point. Damage claims without injury almost never do. Even total losses don't go to court, they get settled.

    BTW......I read your response as if you used a bitchy airhead valley girl voice both because it fits, and for my amusement.

    You may have had good intentions when writing, but since you missed the context of my message.....eh.

    If you both have the same insurance company does the company go all "dual personality" and argue with with itself in court?

    I see Rachel on the stand raising, her right hand and then jumping out of the stand to ask a question and then jumping back in the stand to answer it. That would be pretty creepy....

    BTW, I would toss in the old 'sore neck the next day' claim for a couple of grand...
