Went to dealer today they owed me an air filter, while there they checked my differential no leaks - so they tightened the bolts to specified torq. Thankfully that's the end of my recall.

Dealer said they should start receiving the parts for recall repair next week for the leaky differentials

So if it leaks after being retorqued it's exempt from the recall?

It would still be covered under warranty.

OK, makes sense, but let's just say, if you had 32000 miles on your truck and when you took it in for the recall, they saw no seeping, retorqued studs and sent you on your way. Then at 37000, your standard warranty is up, but now it's seeping. Do you own this issue now? Does the recall no longer apply to you because it was already seen for it and deemed unaffected?

I'm not a lawyer but it seems to me if the recall is still active he would fall under the three criteria, check and tighten if not leaking, replace gasket and hardware if leaking, if additional damage during gasket replacement is found replace diff.

Ya, that's pretty much the recall as it's written. Maybe a better way to ask: Is Toyota treating this like floor mats where every visit it gets re-evaluated?

I think if hardware is just checked and tightened, they would be obligated to continue that practice for any truck subjected to the recall until the gasket and hardware is replaced or the recall is rescinded. After that you'd probably be on your own.

I haven't looked into the standard warranty much, but isn't the diff part of the power train? Should have more miles on the warranty. But hypothetically I think it is up to your dealer past the warranty. If it wasn't seeping, then the warranty expires and it is seeping 5k miles later, I think you are on the hook. Some dealers might do it out of "good will" that close to the warranty ending, but I think that is just to keep you coming back.

A recall is not a warranty item, its a recall. I wouldn't think there is any mileage attached to the recall

Yes but if they inspect it once and deem it ok and then later down the line it starts seeping, the line gets blurred. It isn't uncommon for diffs to start seeping fluid so at some point the line has to be drawn. Follow any chevy/gmc/ford/ram, etc with a few years on it down the road and look at the rear diff. Chances are it will be soaked.

More or less what I was getting at. Maybe they don't print an end date and instead send a notice to terminate the recall down the line?

Usually from a leaking/worn pinion seal. Not a gasket.

That would be true except you have an active recall for that item. While I agree it is common for a seep it will be tough for Toyota to deny an item especially if this is listed with the NHTSA as a safety recall. From what I can tell they cannot put a cap or end on true safety recall once listed with NHTSA

Hard to say, the head gasket recall for the 3.0 V6 was capped at 100k miles. Pretty sure it was a safety item but I think the recall itself had the mileage cap when it was first released.

There are a lot of different types of recall but I would think the head gasket was not safety. If its a true safety recall it has different rules. This would apply more to something like an airbag recall. But I don't know for sure this is a true safety recall, just going on what people here have labeled it
