So... my wife was rear ended on Tuesday morning when she was driving to work. The driver admitted fault to the officer on scene, but my wife did not get her information. Her insurance (Texas Farm Bureau) will not touch the case until the driver admits fault. They won't even give us her name, but apparently she has already opened a claim with them.

It seems like a pretty cut and dry case, but with the lack of information from their insurance company, I'm getting worried that she will tell them differently and say she isn't at fault. We have already filed through Geico, and her Rav 4 is at Alamo Toyota Collision for repairs. Texas Farm Bureau called my wife and asked her a bunch of questions yesterday, as well as drivers license info and details about the accident.

Should we consult an attorney? The initial repair quote from Geico, before the body shop has taken everything down to see if there is any frame damage, is 6500. It's a 2017 Rav 4 top of the line with all the bells and whistles and has 5600 miles on it. We are not wanting to keep it after the repairs are done. Has anyone been down this alley before, and can shed some light or advice on what our next steps should be? I know her value on the Rav 4 will be diminished drastically because of this, and it is still not known whether or not there is any frame damage.

Hate to hear this. I haven’t experienced this but maybe an injury lawyer might help?

Is your wife physically okay? If you don't need medical care, letting the insurance companies battle it out might be the cheaper alternative. After 7 accidents in 12 years living in SATX, I learned that the first thing you want is the police report. If it's in writing in the police report, Farm Bureau can't argue crap. Thankfully the lady had insurance - three of the people that hit me didn't have any (and one didn't even have a license or registered vehicle).

Geico is almost as good as USAA, so I think you can give their collection team a little time to straighten things out. They will be more than happy to get Farm Bureau to pay them back, especially if the police report backs you up.

She does have back and neck pain that is persistent. Another reason why we are wanting to possibly contact an attorney is because of the diminished value on her vehicle now, and we usually end up trading in ever 3 years or so. This one was in excellent condition with less than 6000 miles on it, and I'm sure itll never drive the same or body panels lining up the same, etc... I know in Texas there is something called diminished value that we can claim, but we both work full time jobs and I go to school after mine and we have a baby. I'm thinking an attorney would be able to handle everything we want to get out of this, and maybe a little extra. Someone please correct me if I'm wrong, as we have never had to deal with anything of this magnitude before.

Farm bureau sucks, I would move away from them as soon as you can, they only want to seek you things that make them money.. I dealt with them many emuears ago, when prices started going up I asked why and they basically told me to my face that we don’t make money on car and house insurance, and stated that we don’t care if your prices go up, less then month later I dropped them.
Get the police report.... and throw it in FB face cuz they won’t do anything to help you... just using Capt’s quote as a ref

Yeah, I kind of got that vibe when I spoke with the agent after he asked my wife for a statement yesterday. I'm going to contact an attorney and have them deal with this. Apparently the lady that hit my wife is injured, and the agent for FB has changed to a higher class. Now my agent at Geico is saying that since they are injured as well, they might have to get a different Geico agent to handle our claim also. I just don't want to get screwed over on this whole process.

Get the police report, make sure Geico has the police report, and keep tabs on every dime spent on your wife's medical care. If you have to lawyer up, the focus will be on pain and suffering.

That's way cool, has to be one of the best things about England. I dig the old world architecture & buildings. Definitely a different animal from what we're used to in the US

Ya I love the old world stuff, little disappointed in how little the architecture has changes over the years. It’s apparent that they feed off the US for things.
