    @Tisoy281 Cap's right. Even when you're dealing with the insurance company put emphasis on the pain and suffering. I'm not saying exaggerate, it sounds bad enough as it is, just don't neglect it.

    Don't let them skip over the diminished value. I learned that the hard way. When my wife got hit, Progressive progressively screwed me with that. I was all lined up with a buyer for her car over the upcoming weekend when she got hit by a dumbass who ran a red light without insurance. The insurance company did a shit job on the repairs for her car. I sent it back three times and each time it somehow came back worse. We would have made almost 4k on the sale, now I'm upside down and will lose money on a sale. Progressive didn't and wouldn't do shit for the diminished value. I should have followed through and really hammered them to fix the car correctly (it's still wrong) and compensate for the diminished value but, honestly, I got so tired of dealing with them I said "fuck it."

    I have since switched to USAA.

    USAA is the fashizzle. They have been great with all of our insurance needs, and helped us not get screwed over when we had out house built. Cannot recommend them enough.
    Sometimes, that's how I truly feel.

    I spoke with an attorney earlier and he said the chances of them paying out on diminished value are slim to none. He said our best bet would be to see what we could get in trade in at Alamo Toyota, where it's currently at for repair, and get something in writing that we are wanting to trade in but they are subtracting a certain amount for the accident. He said that would be the best way to do it without actually trading it in and hoping to get a diminished value check after. I sent her car to Alamo because they were the only Toyota certified body shop in the area (Hopefully that makes a difference in quality). Either way, she isn't wanting to keep it after repairs, so I'll have to wait and see what the hell happens in the next coming weeks. I haven't been able to find a lawyer that specializes in diminished value, if it comes to that.

    I have had to deal with geico in the past, I do not have nice things to say about them. Be sure to get the police report, texas is a at fault state so the police need to determine who is at fault for the wreck, the one at fault has to cover the expenses to make one whole 'pre wreck' so i use one or good aftermarket parts must go back on no cheap crap. Most of the time those parts dont fit right and are not up to the oem specs. In my accidents, 3 rearenders, I have not been at fault so the other party was responsible. Geico played hardball so my insurance usaa went after them and sued the other party to make geico pay out. I also would get a copy of the case number and give that to the insurance to speed up the process. Luckily usaa cut me a check each time so I didnt have to wait for geico. I have usaa on most of my rides and hagerty on one but will move my race truck to provide more insurance.

    I have Geico and the other lady has Texas Farm Bureau. Geico has already agreed to pay out 6800 to Alamo Toyota Collision, where my wife's Rav4 is currently at. I already spoke with them to make sure they are using only Toyota OEM parts for replacement. Also, Alamo Toyota is the only Toyota certified body shop in the area. The lady that rear ended my wife DID admit to the police officer on scene that she was at fault, there was no denying it anyways. We are just waiting for the police report. One thing she has NOT done is admitted fault with Texas Farm Bureau, which is delaying us being able to get more information from Texas Farm Bureau.

    Getting the police report should be easy. Go down to the station or local substation and you should be able to get a copy.

    Good thing you're specifying OEM parts.

    That happened to me as well. Was rear ended, got the wreckers details but since they wouldn't contact the insurance so their insurance refused to pay out so my insurance sued them and then the wrecker picked up the phone. Some pros just need to be persuaded. I hope it goes smoothly for you and the at fault one communticates with their insurance.

    How is Alamo the only Toyota certified shop? I had my old Corolla fixed at Caliber (attached to Cavendar Toyota) and what is now Service King (Bandera and Wildflower) and they all did perfect work. You can take your vehicle anywhere you want to be fixed - you're not at the mercy of the insurance company.

    BTW, how's your wife doing? She seen a doctor for X-rays and diagnosis?

    No idea. I just looked for a body shop that would only use OEM replacement parts. We live in Kerrville, and there are only little mom and pop shops over here with mediocre reviews. When I searched for Toyota Certified body shops, Alamo is what came up and they had great reviews on Google. My wife is fine, but she does have pain at the site of her epidural she had 18 months ago when she birthed our son. I spoke with a lawyer earlier, and he said it wouldn't even be worth it to go after them for injuries right now. He recommended for her to go see a primary care provider and get re-evaluated and see if things get better. If the pain is still there after 30-45 days, he said to call him back and he would take the case. We just don't have the time for her to be going to therapy 3-4 times a week (she's a highschool teacher and new to the school) so I think we will take his advice.

    Yeah, I'm really hoping it doesn't come to that, but I guess that'll be handled in the back end by our insurance anyways. The only thing we will be looking for is our 500 dollar deductible back and diminished value on her vehicle.
