I would file in california. Virginia requires you to be legally seperated for 6 months before you can file without kids, one year with kids.

You have access to Legal Support Services on base. They can help advise you on where to file and how to correctly start the process. Please go see them before you start taking legal advice from the internet.

You need to open your own bank accounts ASAP. And do not leave her penniless or you will have a another issue to deal with from your chain of command.

There is a Navy/USMC order that specifically states how much she gets of your $$$ during the separation and divorce process. It is a no kidding formula that the military will hold you to. I will send it to you when I get to work.

It's going to be a long road but it will eventually be ok brother.

We're both active duty so not sure that the ucmj applies on the finance portion. But I'm going to talk to the chaplain 1st today just to get my head straight first. Thanks guys and sorry for exploding on here.

If you are different ranks it could. Seems like 06 is on the right track. But good call on clearing the head, whatever you do-do it in the right mind.

We're both same rank. And I still just don't know what to do at this point so ya I don't know that I'm gonna do something as drastic as filing today or even this week till I get to VA. Cause I definitely am in no state of mind to make life changing decisions at the time being.

abandon ship. She's unfaithful and when you don't have someone that you can trust then how can you expect to build a life off of that? Divorce her. It's going to suck for a long time but eventually you're going to be very happy that you got out of this.

I agree Jeff but the Navy can make you pay her the rest of your life if you don't do it the way they want.

Sorry to hear, but at least it isnt 5 years down the road with kids, owning a house, a a lot more involved. Your gonna be OK, just do it like Matt says and do it right to save your ass first. Try not to let the anger keep you from thinking straight, just remember that you are a better person than she is PERIOD! Hang in there buddy.

    YES!!!! This ^^^^^^^^

Dont think of it that way, that behavior can pay of really well too, just wait till you find a girl that actually appreciates that your gonna be treated like a king!

Sorry to hear brother. These things suck for sure. Changing always sucks, but someone you can't trust isn't a relationship. And trust me you will never forget the past as much as you want to in order to move on. It will rear its head again and again and usually when your not expecting it. Nothing to really divey up and are the same rank. Just make sure you talk to legal. They can definetely point you in the correct way. Make sure which ever one you talk to that she hasn't as they wont talk to you both. You will have to find another

The order I referred to was the LEGAL ADMIN MANUAL. Ch.15. You need to read this.

It was already mentioned by csjumper but you need to go see legal services before she does. Once she beats you to it you can't use that entire office because it's a conflict of interest.

PM me if you have questions. I do a lot of military law as part of my everyday duties.
