Isu - So you would pay the same for a used truck that had Frame damage as you would for one that didn't? If so I have some beach front property in Arizona for you.

On what grounds? I'm not a lawyer, but I don't see a case against the dealership.

The case is that the dealership should have caught the defect upon delivery inspection. Ignorance is not a defense.

Playing devil's advocate, the dealership has nothing to do with this, they'll just pass it along to Toyota Corporate. If it's been determined that it can be fixed under Toyota's warranty, the dealership has no fault or reason to fight with you, you're dealing with the warranty people and their lawyers. I don't think suing the dealership will get you anywhere. If you think their screwing you, think of it this way, for all they know, you took the truck jumping and bent the frame yourself. They didn't do anything wrong in this picture. They sold you what they believed was a new truck. You found a problem, they passed you along to the correct entity to get it resolved. If you tried to trade it in, they'd value it as a used 2012 trade in, just like any other person.

I guess I don't see what you hope to gain out of picking a fight with the dealership?

I'm not doubting that you did nothing wrong and, in your shoes, I'd be beyond pissed with this whole situation. I'd just hate to see you waste money in a lawsuit and end up in the same spot at the end of it all, just less a few thousand in legal fees.

It's not fraud if the truck is really wrecked ;)

It's not ignorance, it's a 5/8" discrepancy in the frame. I'll bet a lot of frames a tweaked to some extent and they go their entire lives and no one ever knows or sees it.

Would you say bad press is the way of dealing with this. A internet marketing campaign?

yeah and then the next truck he chooses has the issue; that would be hilarious but not for the OP

If you were told the truck "may be" damaged and still bought it without negotiating down the price of the truck or inspecting it before buying it that's your fault.

If it were me and I was told it was possibly damaged I would of either:

    A) Walked from the truck and gotten another one
    B) Inspected the truck then talked down the price due to the damage

If you were told up front (as you stated) the responsibility lies on you. You can't go back and expect a new truck when you were told up front the one your buying may be damaged.

I have no idea why anyone in their right mind would even consider buying a new/damaged truck without inspecting it or talking down the price. It boggles my mind

In the end it's buyer beware. If your not aware then get someone to help you next time. There are plenty of resources out there for people to utilize when buying a new car.

In closing I do not feel bad for OP one bit. He should just get the frame fixed and get over it.

First of all let's get this straight... Is the frame damaged or does it have a small twist in it? If it was damaged I would be mad. If it was a little twisted I would let Toyota straighten it like they volunteered to do, and call it a day.
I work in a manufacturing setting. I see all kinds of parts that get twisted or bent slightly. As long as the steel doesn't crease or crumple (I would consider this damage), it is 100% correctable with some straightening.

Why do you think the truck has frame damage? how do you know that this isn't normal and accepted variation?

To me it sounds like a little bit of overwelding causing a bit of warpage.

XXXX - This was not known at the time of the purchase. This was after the frame was lasered. Read the original post and then get back to me.

In closing I don't feel bad for people like yourself who don't start reading a post from the beginning. You must have been the kid in class who failed the test because you didn't listen to your teachers instructions.

Because when I go to sale the vehicle it will be worth less due to the frame straightening.

3 mm is the accepted difference in Frame allignment from the factory. 16 mm is not.

What other damage can be cause by the bent frame? Just asking because I am not a mechanic like everyone else on this site.

im with the OP, if i bought a brand new truck i would expect it to be brand new and not have to be worked on, i don't think there is anybody here that would be happy with that, especially a week old.
