Ugh. 1:30 phone consult w/attorney. Nervous butterflies! Hopefully will not come to any courtroom drama (sorry Keakar, we plan to try to avoid this, probably no Judge Judy for you!), but I figure it's wise to get some advice from a pro on how to best proceed, pending what all is found in the end.....

I've never spoken to an attorney before about anything except traffic violations. This is gonna be weird. Gotta try not to be long winded like I usually am, I only get 30 minutes! I could easily talk my way through that without breathing on any topic, especially this one!

Wish I could just give the attorney this link and ask him to review it, let him know it will only take him a few minutes (or years) :D

does turning tires to black wall out count? How bout added snug top rebel.
I can't figure out why you think the engine builder is at fault for anything. I've been reading this since day 1, and I understand your frustrated, but no engine builder is responsible for every issue your truck had before you took it in for a rebuild. Warm start issue has nothing to do with motor internals, you say motor runs great when running, why do you want to penalize the shop that rebuilt your motor? You've had it at another mechanic for over a week and he hasn't been able to get it figured out, you're throwing parts at it, with no avail, next month are you going to sue this mechanic for all the things he tried that didn't work?

Sometimes things are very hard to diagnose(obviously), and unfortunately for you, your truck has one of these problems. It's not the engine builders fault that this is a difficult diagnosis. They did what they could, I'm sure they did everything they knew of to get it right. The injectors were probably removed and rebuilt and then fuel was run through them, so of course they're dirtier than brand new. I would worry that you're going to get sued for stopping payment on your card, since they did everything that they invoiced you for.

Sorry to not agree with your thinking.

I think you should start a new thread asking for advice on hard warm start, to get some new opinions from people that don't want to read 60+pages.

Jeez. Ya'll rowed 3? pages forward, you must be feeling better about getting the truck back. Chatty Kathy's.

Yup, The Blue OX. You walk up and out hurting from that place. Need to send the Booze Traveler there. A time machine down there. Very cool.

See what your guru says about running that ecm first for awhile,,then swapping out for the replacement ecm. To give you a better feel for a improvement or a decline between the two boxes if needed. Savvy?, No need to put juice thru a loaned box if you don't have to,,those are like gold.

Is this guy a teacher? or?. What College?. He has the patience of a Saint.

Hopefully the court will see it in your favor, but don't count anything out as you have learned. Pack several big folders and books into the courtoom,,even if you don't use the books,,set that shit all over the table, organized for the long haul,,;);). You will see the color drain out of the judges face,,,lol. Has worked a time or two,,just sayin.

Try not to haze the tires for awhile,:burnrubber: I know its hard and sometimes unavoidable in this wet shit,,but we don't want free tire spinning rpms on those parts just yet. Add throttle as the motor needs it. The parts are lapped in together by now,,but we want to surface harden them with eazy miles (for lack of a better description) for the next 2000-3000 miles or so. Plus,,it would suck tremendously if it failed.

Gramps always said "Everyone has a 426 Hemi when it rains".

Well, her mechanic is gonna be in Florida for a while, so she pretty much has no choice but to run the original ECM.

A bit of searching found that they are pretty easy to swap out. Drop the glove box, glove box bracket, a couple of screws and unplug some pretty big wire connectors. I've not done it but read that it can be tough on the fingers.

Just spotted that part. Sucks to have someone close in a bad condition.

Yah, doesn't look to bad to get at. Set aside a full day on a daily driver if never tried before. Good rule to live by on this side of the fence.

I disagree with some of the things you've said. But you don't have to apologize for disagreeing with my thinking - we are all entitled to our opinions.

You said you've been reading this thread from day one - did you happen to read the posts regarding what our new mechanic has found in going over our truck since the engine mechanics worked on it? If not, perhaps you should take a look at that information before forming your opinion.

I couldn't agree more regarding your statement about how an engine builder is not responsible for every issue my truck had before I took it in for a rebuild. However, again, your comment on this makes me think perhaps you haven't read everything here. THIS ISSUE WAS NOT PRESENT PRIOR TO THE WORK PERFORMED BY THE ENGINE MECHANIC.

Also, I'm thinking perhaps you missed this, which I posted this morning....

And that is exactly why I am not seeking a dime back from them until we have the truck completely repaired and know all of the facts.

You insinuated that next month I would sue our current mechanic for things he tried that didn't work. I'm not sure what makes you jump to this conclusion, but you're entitled to your opinion. Let's see, I've discussed working with two mechanics in this thread. I paid one of them $6K to replace my engine and perform all labor associated with that, as well as to test my fuel system and service my injectors. Then I received my truck back with an issue THAT WAS NOT PRESENT PRIOR TO THE WORK THEY PERFORMED, 2 faulty injectors, a dented cam sensor, and a variety of other issues THAT MOST, OR PERHAPS ALL, WERE NOT PRESENT PRIOR TO THE WORK THEY PERFORMED. I've expressed on this forum that I am not pleased with that outcome. I have also expressed on this forum how grateful I am to my new mechanic for working so hard to correct the sloppiness of their work (his words) and attempt to solve the issue THAT WAS NOT PRESENT PRIOR TO THE WORK THEY PERFORMED. Sorry, I'm having trouble understanding why all of these things lead you to believe that we will be suing this mechanic next month. But again, you're entitled to your opinion.

Yet 2 injectors came back failing, 3 weeks and 300 miles after being professionally cleaned/tested/replaced as needed? Guess you missed that post too. I'm no injector expert, perhaps you are. That doesn't add up to me, nor to the person who cleaned/tested them the "2nd" time, nor to our new mechanic. But maybe you know more than they do on this topic, do you run a fuel injector business by chance?

I actually considered starting a new thread as you suggested, but just never did because the folks on this thread have been pretty darn good to me. Well, the vast majority of them. Perhaps I will do that, thanks for the tip. I'm sorry you don't like the length of the thread, but no one is forcing you to read it.

EDIT: A large part of why this thread is so long is because I have been working all day, every day, since the issue began THAT WAS NOT PRESENT PRIOR TO THE WORK THE ENGINE MECHANICS PERFORMED to try to determine the cause of the issue. And while I'm primarily doing that to get my truck repaired, I'm also doing that to better understand whether or not they are responsible for the issue. Because I have no desire to seek anything from them for something they are not responsible for, but I damn sure do have a desire to seek something from them that they are responsible for, as any reasonable person would.

If they cannot find the problem, they will sub the job out to another/more qualified and equipped mechanic..... that is what I would expect from them as a reputable company.

so far they have acted more like a shady used car lot then anything resembling a reputable company. it is too much to ask but you would have to start several hundreds of posts back and start reading on how they treated her when she said something wasnt right

The issue here is an installation/set-up/tuning issue. The individual(s) who assembled the engine is ok... the engine works.

The problem is directly related to the work that was done. Jen never mentioned it's the shop's fault because her wipers don't work or her windows don't operate smoothly.

You said it man, chatty kathy for sure! Keakar and I got ta jowlin this morning, added damn near 2 pages if I remember right! All highly technical Tacoma troubleshooting talk I'm sure, right Keakar? ;)

Not sure what all our mechanic teaches, but I know he teaches something (gotta be an automotive course) at our local college. Pretty cool, huh? He had us go pick up the cam sensor he'd already called in at Schucks, and told us to mention the school's name to save 10%. Every dime counts at this point! I would seriously consider taking whatever class he teaches, he's just a super cool dude, so nice, and yes, exactly - the patience of a saint! I gave him a big bear hug right after he started it last night when we picked up, cuz we both looked like we were gonna cry that the damn thing is still doing the excessive crank time. Love that guy.

Ha! Love your tips about the giant stack of literature for a court room! Too funny! I see what you're saying though - if I was that judge, I would be like, oh crap when I saw me coming - Miss Details and her 8 billion files of notes and records, oh boy - when's lunch? :D I doubt it will get to that point, but as I said earlier, I wanted to get some advice from a pro, and that guy was super nice and very helpful. Recorded the call so hubby can hear it tonight. We have options, but as my colorful post above with all the pretty bolded statements says, none will be pursued until all the facts have been gathered. And pending what they are, who knows, maybe nothing will be pursued in any manner. But I doubt it.

Wait, so no Dukes of Hazzard moves in the Taco?!??! Aw, c'mon, you're no fun! I thought you instructed us to floor it up the Timberline access road?!?! Ha ha ha :)

Thanks for researching this K! Too damn nice man. How the hell will I ever bake enough cookies to repay you??!?!? :):):):)

Yeah, I'm hoping it's straightforward. Honestly, it is a little scary because our mechanic has pointed out more than once that these things never fail. Which must mean these things rarely get swapped, even by an angel genius mechanic. But, if anybody is up for the task, I would think it'd be him, so we'll cross our fingers that all goes well.........
