You don't need a lawyer. That's what I was saying. Your insurance will make you whole, and then they can use their lawyers to get the money from DHL. That's worst case.

Best case, you tell insurance, they tell DHL, DHL pays out without fighting or trying to screw you.

Absolutely. Full repair with only Toyota parts, none of that "oem equivalent" nonsense, and diminished value if allowed by law.

This honestly shouldn't be a fight for you. You have video and it's a commercial vehicle. Your insurance will know this isn't coming out of their pockets, so they'll be less resistant.

 

Yea my wife was saying the same thing. Most if not all lawyers/accident law firms won’t take the case because there’s no bodily damages and only property damage. If they take it, they will charge you about 30% of your settlement. Your insurance is more than capable of getting you taken care of but it’s always good to at least call a law firm to weigh your options.

Another good point made here was the diminished value. Ask your insurance about that because there will now be an accident and repair on the vehicle. Especially if it gets branded a salvage title, you should be getting extra money for that.

 

Shouldn't be branded unless it's declared totalled. If that happens, take the $$$ and buy another.

I’m hoping it’s not a fight at all. Man my luck with vehicles. We just finished another insurance fight when a Boulder rolled down the hill in Verdi and hit my wifes car when it was only a few months old lol

that was the construction companies fault with the excavator sending the boiler down the hill.

This is so simple, if your insurance fights you on it I'd fight hard and then start shopping for a new insurance provider.

For now, don't stress and worry about it. You've got proof. It'll all go your way. Get some rest and know that this won't matter in 5 years.

 

One more thing, you may want to keep a copy of that video, and not post it online until it's resolved. Just in case.

If you made a police report already (I forget) I would say maybe contact them and add you have found additional evidence re DHL, nothing more.

 

We updated both the police report and the insurance claim with the video evidence

IMO if anyone asks I would say you want charges filed against the driver for hit and run too but nothing else. There's no way they didn't know they hit you plus I suspect it's not their first time, work or personal time.
