    If he gets a lawyer I am sure the lawyer can make sure the defendant pays the fees. Easiest is to file a small claims, once the letter shows up they usually back down.

    There is more to this story then I think we are being told. How is it you can not charge him for trespassing? If you kill the cows you are held liable how is he not held liable for the cows trespassing? Sounds like someone has an in with the sheriffs department.

    problem is the cows are fenced in on his property, so they know there was some kind of agreement.

    If your neighbor has been maintaining and using the property and the fence for more than 7 years ... you might have a problem on your hands

    I had an easement issue with a neighbor. He needed one but didn't want to pay for it. My lawyer, that I had to get after being sued by my neighbor, told me that if I allow my neighbor to put up a fence or clear a road on my property that after 7 years the judge will side with the neighbor since the neighbor wasn't an issue for that time frame

    Find a lawyer that knows property law - I had to weed out a few

    My neighbor got his easement but not where he wanted it

    And he paid thru the nose for it - 2 years of stupidity - we don't talk anymore

    It's your property - if he doesn't remove the cattle then you will need to file a lawsuit if a letter threatening a lawsuit for noncompliance doesn't work

    I've had people give the "I've been hunting out here for 30 yrs" ...

    I pay the taxes, it's my land. You and yours need to leave. Period

    There is nothing wrong with calling the police when he trespasses

    But protect yourself physically and legally

    Typically police departments do not get involved with civil disputes, even though the cattle are on the OPs property, there WAS an agreement allowing them there. If OP harms the cattle then it's possible that he would be held liable or charged criminally depending on local laws.

    It shouldn't matter if there WAS an agreement. The OP says it is his property and he obviously no longer agrees to let his neighbor use the property. That equals trespassing and should be enforced by the local law enforcement. Unless there is more to this story.

    Trespassing can include a tree hanging over a property line and you say you don't think livestock on his property entails trespassing?

    trespass
    n. entering another person's property without permission of the owner or his/her agent and without lawful authority (like that given to a health inspector) and causing any damage, no matter how slight. Any interference with the owner's (or a legal tenant's) use of the property is a sufficient showing of damage and is a civil wrong (tort) sufficient to form the basis for a lawsuit against the trespasser by the owner or a tenant using the property.

    The Sheriff will not get involved until it is trespassing issue, since the person did have permission it is not yet criminal, until he is "legally told" to vacate the property (similar to an eviction notice) I have a lawyer that I am meeting with tomorrow he needs to see the deed to my property and my title insurance. He will draft a letter and he is pretty sure that will end this as each party has to pay court cost in Florida, I am sure that the neighbor will not go to court.

    Never fails... No good deed goes unpunished.

    bottom line is he needs to hire a lawyer well versed in Florida property laws, and then make sure that they get lawyer fees as part of the judgement

    Law enforcement aint gonna do a whole lot about it because it is a civil issue as opposed to a criminal issue.

    Good way to go! Given the fact that he feels he has right to this land, legal action is the best way to go that way in the future he doesn't try this bs again. And from now on NO handshake deals especially with friends and family.
