Open a case w corporate, and ask them to dig in deeper as to why this is happening on a 300mile motor.

 

Unless Toyota corporate steps up and compensates the dealer for trade to a new truck, he isn't going to get a new truck. This isn't the first and won't be the last time a new vehicles has had an engine failure. It's rare but it happens, and it usually happens immediately like this due to a manufacturing flaw.

Massachusetts has a lemon law. i can void the deal. so they better do something...

 

That is the most appropriate push you get. An extended warranty on the component that experienced failure.

It is worth noting, that you should be hyper active in documenting any other issues that could be consequential.

Just in case the failure to fix becomes a case for a lemon law replacement, but you are on step 1 of like 10.

 

They are in no obligation to do anything other than fix it, if the issue has not been fixed after three or more attempts, and 15 days in the shop.

So, the advantage quickly shifts in your favor if they don't fix it right the first time.

Know your lemon law before you try to use it. Usually the same error has to happen 3 times, or the dealer/mechanic refuses to fix it. This happened, if they offer a new engine to fix it, then you won’t be able to use the lemon law at all.

edit: and I could be wrong too. I’m not super familiar with lemon laws, but I’m also not trying to use it. Just saying you should read up on it a lot more before you even say anything to the dealer. And I’d go through a lawyer if you do try to lemon it, it’s a 35k truck, the dealer will try to fight you on it.

 

Sucks OP but your fight isn't with the dealer; it's with Toyota. It's not the dealers fault it failed, they don't get to decide the lemon law case (which I doubt you're eligible for at this point) or to give you a new truck. That's all Toyota. All the dealer has to do is fix the truck under warranty (again paid by Toyota and not them).

 

Agree with this. Demanding something unreasonable, will just mean it takes longer to resolve.

If they offer to repair, and you lawyer up they have zero obligation to help you any further since you declined the repair.

As stated earlier, document everything, because the lemon laws include consideration for damage that was consequential to the initial issue and or repair.

These considerations are not automatic, and that is where legal help will help you argue the parts of your case that are up to interpretation.

In general, when engaging legal help, it's always good to know what the value of the argument is, and what the facts of the argument are. Engage legal help when you can't successfully argue the facts and when the value of the argument justifies it.

I can see them maybe doing a trade for an equal truck. Highly unlikely to get an upgrade. Tacomas are almost never discounted and when they are it's maybe $1-2k. Highly unlikely in this market though.

You're not going to get a new truck. Once you sign the papers, Toyota just needs to provide fixes per the warranty. Unless your case eventually meets the lemon laws standards of your state, they aren't required to buy the truck back. Since they were able to determine the issue, they will fix it and unless the same cylinder fails repeatedly, there's no chance it'll fall under the lemon law. Things happen, that's why there's a warranty.

 

Man, i was so pissed when the tech tore the corner of my seat. Had to fight with them for almost a year to fix it. I cant even imagine if i had an engine problem that early on. These trucks are not cheap and money doesnt come by easy.

 

I would like to see a copy of the " PDI " pre- delivery inspection .
Any engine oil in the motor ?
Its not the first time I have seen a dealership skip out on performing all the checks on the list .

First thing i checked after i did the paperwork and got my keys, was to check the engine oil. Luckily, It was bang on.

My buddy bough a brand new taco in 2013 and oil was overfilled.
