    It would be covered all day long if he has insurance. They would have to prove he did it intentionally to total the vehicle. His intentions were recreation which has never been in a insurance policy I have written or read. I had a knuckle head jump a raptor. It was intentional. But we paid to repair.

    Perhaps not. If there was a legal road closed sign then maybe not. I'm pretty sure that if you drive past a legal road closed sign then you could be on your own for repairs.

    I'm pretty sure of this.

    So, no. I don't think it's a slam dunk.

    I'm sure it would be covered unless it could be proven to be intentional.

    We had a guy insured who wrecked his Porsche 993 at Sebring during a PCA event. He towed it outside the gates onto the road and then called in a hit and run to the local police. Police filed report, he filed claim. Claims adjuster did his homework and got the roster from the PCA event and proved he was on the track. Guy filed claim anyway and the company took a reservation of rights stating they had no duty to pay and threatened to file fraud charges if he proceeded. Guy withdrew his claim and fixed the Porsche out of his pocket.

    A lot of claims that are filed are from negligent behavior but are paid because it's cheaper to pay than investigate. Companies just absorb the losses and in the end the actuaries pass the cost onto the consumers. It's all murder by numbers.

    Racing is an exclusion. Stupidity is not. It depends on intent. His intention was not to total his vehicle. Road sign is irrelevant.

    Even a shady insurance company would pay out. This is weather related accident.

    Now if there is more information such as the vehicle having mechanical issues prior with a large amount of negative equity, high miles... It might warrant a fraud investigation. Typically still ends with a payout. With out OP saying yes my intention was to total the vehicle or a witness to say his intention was to total the vehicle his insurance carrier would pay up in heart beat! If not DOI would be all over that carrier wanting to know why. And a having a hunch or gut feeling is not even close to warrant a denial.

    If he has the coverage and has paid his premium he is totally with in his rights to file a legal claim and receive payment. All accidents are from poor judgement or mistakes. He is with in his right to collect for his mistake/ poor judgement. No different than the guy who totals his taco while doing 70 in the rain down a dirt road. It's an accident, its what insurance is for.

    I remember during Hurricane Agnes in 74 watching people actively driving/pushing/in some cases towing every running or nonrunning junker they had a title on into the Schuylkill River for the disaster money sure to come. :rolleyes:

    Tough to understand insurance. They deny people with legit health problems. Yet they pay people to have a good time driving their new trucks into a lake. No emergency. No survival. Not even in a hurry to get home for dinner. Just making sure that the truck actually won't float. The agent is like, "Oh why didn't you say so in the first place? Your truck didn't float? What the hell? Here's your $35,000. Please excuse me cause I'm busy denying health insurance. Better luck next time!" Makes no sense.
