    Could be that or a little something else, maybe a townie buddy-buddy thing or someone not wanting to make waves. Fortunately the second time his ride got towed I happened to be first on the scene of his accident (dumb luck) and at least grabbed his CD binder before anyone else showed up so I saved him something that time.

    Agreed both ways. Pretty disgusting especially when the lie is so damn blatant. One guy who backed into the driver's side front fender of me tried claiming I had rear ended him, told the police I left the scene (which I didn't), and refused to give me his information or speak to me..then I caught guff from the police for calling them. He seemed a little friendly with one of the cops so I surmise there's something there, perhaps

    I am actually getting increasingly agitated with him. On Wednesday they had put a note in the computer that they would allow me to get my shell, swap tires, and the battery. I was not able to do it all in a day so I informed them I would be back Friday for the tires. I drove an hour to the yard today and they looked in the computer, State Farm revoked my permission to get my tires

    $13,750 I wanted $14,500 but he said he wouldn’t budge even after pointing out some inaccuracies with the vehicle condition as well as comps. Appraisal cost me $600 and my insurance company $500 and they got $15,350

    Unfortunately I’m going to have to send this to a PI attorney. The other drivers insurance and mine had a 3 way call. The other drivers insurance acknowledged that they ran the light, crossed 3 lanes of traffic, and fled from the scene (a witness followed them until pd pulled them) but stated that they are denying the claim because in the witnesses opinion I could have possibly swerved left or right, therefore are holding me partially responsible.

    the witness according to the other insurance is retired traffic patrol of some sort so they said it’s the most credible thing they have.

    my measurements indicate that when the vehicle approached the intersection, the position of where I was and where I ended up was about 40ft travel. At 45 mph it’s 66 feet per section, on my dash cam in another vehicle the area the other vehicle came from was not visible 50ft from the intersection

    If someone intentionally leaves the scene, one would think they should be held at fault automatically. They lose the right to argue fault after that point

    Hence another reason I recommend OP press that piece criminally as well, maybe that will teach someone a lesson.

    Any of you legality gurus know if you can have someone charged with hit and run after the fact?

    there is an independent witness that followed the other vehicle until they were pulled over, but pd never charged her.

    her insurance has been making my life and my moms a nightmare, has denied responsibility for the accident on the fact that our state is a 1% state and they put a percentage of fault on me stating I could have swerved to miss (my insurance put 0 fault on me)

    as a result I’m out a few grand in doctors bills, wages, and deductibles and the driver that ran the light is Scott free minus her deductible

    If they say you could have swerved then maybe she could have not hit you. What kind of bs is that arguing a hypothetical. Fact of the matter is You had the green, she hit You, then fled. How that gets confused here is beyond me. As for insurance Nickel & diming you isn’t reasonable but that’s just what they do.

    it has gone beyond nickel and diming, unfortunately, they denied my claim 100% based on that hypothetical. As far as my mothers bills and injuries, they keep threatening to close out the claim because of lack of responsiveness, however, she keeps leaving them voicemails on a recorded line and they are the ones that refused to respond. The company itself is only about a 2 Hour Dr. from where I live, so my plan is to maybe make a trip up there next next week and show my face in person

    I'd call the courts tomorrow and file it. Don't waste time with the other driver or the insurance, just do it.
