    Yeah definitely a screw up that's happened to me once with my CU. The TFS loan is a contract connected to a credit report & score. Why not call them & let them know what happened. Correct it sooner than later? That's what I did.

    No he does own it outright according to the title...the lein was never recorded. He is in possession of the original title. The bank can’t dispute a copy only the original and they need to be in possession of the original to do that. What he has is an installment loan in his name not secured by any collateral. If the bank wants the title back say sure and let them know what your fee is to that. It’s their mistake why should he take time of of his busy schedule without any consideration? They sure as hell didn’t give him the money for free. $1000 bucks to surrender the title sounds fair to me it would cost twice that for them to chase him for it. That way everyone’s happy.

    I owned a car dealership for many years. This happens occasionally, they will request the title back from you. You signed papers stating that the truck will be collateral for the loan. Either give the title back to them or wait for them to request it.

    When it comes to the law it doesn’t matter who’s right...whomever has the better argument always wins. That’s his title and the bank is not a party to it...oh but they want to be...and they can be for a fee.
