    In my experience, cops are usually more aggressive towards sobriety tests under 21. Have a pal with a kid that got an Extreme DUI at 14. Talking yourself out of a DUI at any point is hard but under 21? That's unheard of.
    Unless..... His family is connected. Someone he's related to plays golf with the Chief.

    probably wasnt 60...
    along with the bed of the truck, the side swipe angle & the rear diff bolts letting go, absorbed most of the impact....
    NOBODY can really know he was doing 60.........

    No one is claiming the impact was at 60. Unless I am misunderstanding the perp admitted to driving that fast before the accident. OP stated he bogged down before impact in the mud.

    But how cost effective would that be...
    If ins co totals it, you have the option to buy it back from them...
    They dont just give it to you, & wont be for pennies...

    I think it auto-stopped for him, and he slid through our yard (leaving a giant rut in the mud/mulch) and so the impact was probably at closer to 30-40mph at most, but yes, this is after it hit my truck and my wife's car... shocked it even had a hood left. new cars are pretty amazing. but yes he was def going at least 50+ coming down the road when I saw him, I KNEW he was going to crash. it's a hairpin turn. picture attached shows how he wrecked.

    basically: totally lost the 2nd turn, kept going straight, hit my truck and flipped it around 90 degrees, flung it into a dumpster positioned behind my truck (which bent the rear bumper in, but the bumper is an aftermarket steel one that has not even a scratch somehow??)

    after that impact, his car bounced left and into my wife's car further up the driveway, bumping into it at maybe 5-10mph, only messing up the bumper (Subaru Forester).

    he admitted to police he was speeding and lost control. admitted he was texting.

    got back from the impound lot where they took my truck. it's 100% confirmed dead. he bent not only the bed, but the rear frame is tweaked enough that it bent the body as well (the doors won't close right). took everything I could from it, even the WeatherTech floor mats. the hard top is still on it, if insurance won't pay me for it, I'll offer it up to anyone who wants to grab it (it's fiberglass) as I have no way to get it and store it.

    also got the police report, they only charged him with (1) failure to control (2) failure to maintain lane (3) reckless driving (4) careless driving. he admitted to speeding, texting while driving, and was def drunk... so I guess they just used descretion on all of that. oh well, not my problem: he's still very much screwed.

    but what makes things worse is we have the same insurance company (Geico).

    Scrubbed some tires, and knocked a dent out.
    I was witness to a rear ending where the victim couldn't feel anything below her waist.

    The mother of the accident causer pulled up and said "he's drunk" or something along those lines. When another guy mentioned this the officer on scene said he would be able to smell it! End of story besides I always wondered what happened with the poor lady who did nothing besides stop at a red light.

    Jeez... It's time to get a Lawyer to get you the maximums from your insurance. We had to do the same with my GF when she was hit with an uninsured motorist. The insurance company was just playing with us for 2 weeks until the lawyer got involved.

    edit** in that case the cop didn't ticket the other driver for having no insurance and also did not do a sobriety test on the guy even though he was drunk. He even admitted to being drunk to the people on site. It was bazaar.

    In my state there is a threshold, based on mph above the speed limit, where a speeding infraction becomes a reckless driving misdemeanor. I think almost any infraction can turn into reckless this way. Texting infractions can be handled the same way. He could be charged with reckless and the texting could be an aggravating factor impacting the disposition, which could include jail time, if your state is anything like mine. He wouldn’t be charged with both speeding and reckless, here at least.

    The drinking unfortunately is water under the bridge but the reckless charge should have some teeth to it, especially combined with the other charges and the circumstances as a whole.

    Does the report document that he was texting?

    Who the hell texts when doing several times the speed limit on a not straight road? That’s just nuts.
