    Do you have uninsured motorist coverage? You can turn it a claim and they should waive your deductible. You have all the proof you need, along with U Hauls statement. Worse case, is your carrier will pay for the damage, you might be out your collision deductible until they subrogate against U Haul and ask for reimbursement.

    If you do sue, be prepared to defend why you felt the need to stand at a window and start filming when you did prior to the contact with your car.

    There is a "reasonable person" standard that could be an issue to overcome here. For example why wouldn't you move your truck out of the immediate area if you felt this was a shady situation? This will be U-Haul's strategy. Then they will likely claim that you could have been part of an insurance scheme if you knew it was going to happen and you filmed it.

    I'm pretty sure the standard of proof is low in small claims court, so even a strong allegation on their side could be hard to overcome.

    Then again U-Haul took all the liability here by renting a truck to these idiots without insurance. However shitbags like this probably cancelled their policy and kept their cards as "proof of insurance" and used it to rent the truck.

    Most likely a letter from a law firm will be all that's needed. Uhaul shelling out a couple grand will be cheaper than them going to court and having to explain why they rented a truck to someone that had no buisness operating it. I think most Uhaul stores are independently owned and operated so you may end up having to sue the store that rented it versus Uhaul. They should have buisness insurance though.     It's still U-Hauls liability. If they were smart they would work with you. Also when it comes to getting the damage fixed, take it to where YOU want to take it, not where U-Haul wants it to go for repairs.

    It will not go up if you claim through under-insured/uninsured coverage. Your insurance company will go after the responsible parties, let them do the job you pay them for!!

    Lawyer letters go a long way. Can be $500+ though. Get some estimates of the damage from a couple of repair shops. Then tell U-Haul: "We can do this the easy way...or the hard way". Do it Clint Eastwood or John Wayne style. :quickdraw:

    Talk to your insurance agent. They will do all the "going after everybody" stuff if it's a big damage claim...which this looks like it could be. Could exceed small claims courts maximum award limit.

    This is the best advice. Let the insurance company do the heavy lifting here...that's what you pay for in the premiums they charge.

    It's great they caught those idiots.

    This usually doesn't work with large corporations...might work on a small business but most are willing to take the risk, it takes a lot of effort to pursue legal action. It would cost far more money and time than just fixing the damages on his own.

    One of the guys at work lost the front end of his car to a Budget rental being returned. Guy said he didn't "hit anything". Too bad paint transfer happens :)
