    Bingo!

See Whitetail's quote above. If he finds himself in a situation where his vehicle should be totaled, and he ends up presenting medical issues, I would think an attorney would have preferred OP had not posted.

A quick Google search says Indiana requires 70 percent repair to total. I'm by no means an expert. I think 4x4runner said 25-27k to total. That's probably spot on.

I doubt there's that much damage personally. But you never know.

I would say if there's frame damage there's a good chance they'll total it. If the frame is good they'll probably fix it.

^This! You gotta fight for your truck if you were not at fault and if it isn’t totaled. It can and may show up on Carfax. If it does, dealerships or private parties can see it and use it as a bargaining tool if trading or selling your truck in the future.

I would say total, and if it was mine I would be hoping for total. Better the truck than you.

I witnessed a 3rd gen get hit on the interstate about a month back. The person who hit him lost control going well over 100 during a police chase. I was lucky to have slowed down and got out of the way or likely would’ve been involved myself. The guy in the truck walked away. Truck looked bad but it did it’s job. The other guy was not so lucky, his car was unrecognizable. It’s certainly nice to see they do a good job of keeping you safe when you need them.

Tell them before they offer to fix it that you are also claiming diminished value in addition to their repairs or replacement. Personnaly I would hope they total it, but its your truck that obviously saved you. We just got rear ended and are Ok, my daughter has some whiplash issues but is mending well with the care she is getting. They totaled the car but gave us more than what we could have sold it for on the private market before the accident, so now my wife is driving a 2019 Rav4. Good luck, and be courteous with them- worked for us (well Ok, it may also be due to the medical issue so they are bending over backwards to stay nice!)

They also look at what they can see it for at auction at copart or iaai since these trucks go for a lot at auction they can total easier if the bid comes back high. They also factor in how much rental they would owe during repairs

No idea.. But I would say it would possibly be based on the type of accident... thats purely a guess though

SMH... Sad. Of all the things you could post, this is what you choose to say to this guy just giving an opinion. Ridiculous. That’s why these threads turn into complete shit shows.

I'm not sure of the percentage, nor if they look at what level the accident was .

I have a feeling they don't actually look at what it was since an accident is an accident and it will hurt the amount you get back. Even if it's just a little fender bender

Sometimes it takes awhile for injuries to be discovered- and able to be attributed to an accident. Things like stiffness and headaches can be soft tissue damage, etc. In California a person has two years to file a claim after an accident. Recommending not mentioning anything that is unknown, he should wait a few weeks to be sure.

Well I'm not the only one who took his post as the same.

I see your point as he mentioned for @4x4Runner.
But just like with 4x4runner to me it sounded different.

Some people just seem to look for anything to sue over. Fuck my brother in law was rear ended and the guys wife who was in the car tried to sue my brother in law for injuries and not being able to go back to work .

This was over a little bump no air bags or anything. And her husband was at fault.
Sorry it's shit like this and the fact so many try to get rich off insurance made me think that's what the guy was posting about. Not that whiplash etc could show up later

Ya figured that, but given a lawyer and a simple medical exam could explain that I don't think a post saying you didn't have any injuries at first is that alarming.

If it's not totalled out & you get it fixed, look into "Perceived Loss of Value". Basically states a potential buyer (if you were to sell it, even if you aren't) will perceive the value lower than what it's actually worth. You may get a nice bonus check from insurance. That happened to a friend on his 2014 Taco, when he was hit, got 5k for that.

First off, no offense taken from anyone.

My only point is that if a lawyer ends up getting involved, and it really gets nasty, any posts like this are going to be pulled under Discovery, and manipulated, turned around, misinterpreted, etc.

If you want to post that your truck was in an accident, okay. Frankly, asking any of us for opinions on whether it is totaled is really a bit silly. All we have to go on is a few pictures and a description. It will be up to the insurance companies to sort it out.

While dishing out my totally unsolicited and worthless legal opinions, I forgot to tell the OP am glad he is okay. Material things can be fixed/replaced a lot easier than people.
