    Opting out means from the classaction settlement...not from a possible frame coating or replacement. If you opt out then you are on your own to see action against Toyota...probably not gonna happen.

    You only get reimbursement from Toyota if you paid to have your frame replaced and then Toyota settles with customers to replace frames on their dime.

    If you bought the truck after December 2016 you are not included in the class action suit.

    Even if you bought the truck after December 2016, your truck is still included in the settlement. The settlement benefits run with the truck, so once the settlement begins, you'll be eligible to have your truck inspected, etc.

    The long class notice says it runs with the truck. The settlement agreement also says it, but less directly. The papers filed in support of the settlement also state it. Once the settlement goes into effect, if anyone has any problems they should call class counsel at 619-338-1100.

    Nice, not that it applies to me, but good for anyone with a rusty frame.

    What does this section of the frame settlement mean then, as it's been confusing me?

    It means that the person who bought after December 2016 is not part of the class, but his vehicle is through the vehicle's previous owners or lessees. The class can't legally include people who buy the vehicles in the future - there has to be a cut-off date - but the settlement can still allow for vehicles that were sold or leased at some time during the class period to be entitled to the benefits under the settlement.

    This is why I'm not a lawyer...

    So what does that mean exactly, the vehicle carries with it the terms of the suit but a person who purchased the vehicle after that December date is not?

    I understand having a cut off date, but was this included so that second, third, fourth owners are included?

    That's exactly what it means. Future owners can't be legally bound, but given the nature of the problem, it's important to allow the vehicles to be inspected and, when applicable, their frames replaced. So there is no need to keep suing over the same thing whenever a vehicle in the class is resold.

    It sounds like the settlement has been approved. Anybody know what's next? Do we just wait to hear from Toyota of somebody else?

    Yup, It appears that the final order was entered on Monday the 21st.

    Per my understanding there is no action required other than to present yourself to a Toyota dealer and ask them to inspect your frame per the terms of the Frame Inspection and Replacement Program established by the Brian Warner et. al. v. Toyota class action suit.

    I would not expect most Toyota dealers to know much about this right up front, it will take time for Toyota to provide them with policy and procedure instruction/documentation. Don't know it Toyota will be re-notifying owners either--should be quite a circus with an expected 225,000 eligible vehicles...

    You will want to bring the Final Settlement Agreement as well, however I suspect most dealers will say they have never heard of it and/or tell you they have to wait for policies and procedures, service codes, etc. from Toyota...

    Last time my truck was at the dealer they recommended that my truck have the frame be replaced. They put it on the invoice. It had already been coated less than 14 months/8000 miles ago. I was fighting with Toyota about getting the frame replace when this settlement hit the news. The Service Manager told me to hold tight till the settlement final. I guess I'll just give him call and see what's up. Does anyone expect to hear from Toyota via written letter?

    Initially it is up to Toyota to send notices (or not), when just 6 months remain in the "CRC States" they must send notices.
