    You may still receive coverage under the class action suit, although hopefully you won't have a severe rust problem. For help, call the lawyers representing the class at 619-338-1100.

    Anyone know where this postcard mailing generated the addresses to use? I got the card today but it went to the wrong address. Just curious if anyone knows..

    I do not know for certain, however it was likely state vehicle registration information and whatever address Toyota had on record.

    Here is what the preliminary approval says about the direct mail notice:

    The Direct Mail Notice, which will be sent via U.S. Mail to class members identified by R.L. Polk & Co., (see Dkt. 91-1, Exh. 9, Finegan Decl. at ¶ 16), describes the nature of the action and identifies the Subject Vehicles. (See Dkt. 91-1, Exh. 6 (“Direct Mail Notice”) at 1). It advises the recipients that Toyota’s records indicate that he or she may be a class member for the vehicle with a certain Vehicle Identification Number and that the class member’s rights may be affected by the settlement. (See id.). It also describes the relief provided by the settlement. (See id. at 1-2). 26 Case 2:15-cv-02171-FMO-FFM Document 98 Filed 12/02/16 Page 26 of 31 Page ID #:1713 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Additionally, the Direct Mail Notice: informs class members how to obtain the Long Form Notice by visiting the settlement website, calling the toll-free number, or writing to the Settlement Notice Administrator; provides the deadlines for opting out of the class, submitting objections, and submitting claim forms; and includes the date of the final fairness hearing. (See id. at 2). The Direct Mail Notice states in bold: “If you are a class member, you must consult [the settlement website] to determine how this settlement may affect you.” (Id.) [emphasis added]

    hmm, strange. It certainly didn't go to where the vehicle is registered..or my registered mailing address according to USPS

    Was it an address you have ever been associated with? It may have been an address Toyota had on record, or some other source--direct mail notifiers use a bunch of resources and try to determine the most valid of each individual's addresses. It is an inexact process...

    Previous owner? As I said there are some convoluted and imperfect algorithms used to make up notification lists for crap like this...

    Nope, it was my grandmother 2 blocks away. I have never used her address for anything and our last names are different. Its driving me crazy :)

    Do we have any hope?

    I also have 2006 that had the coating done and all it did was spray over the rust. That is now flaking and rust in the beams in some peripheral areas is through and through.

    I am curious what others are considering doing if they have received the spray and still have widespread disease?

    Are others "opting out?"

    Was it addressed to you (your name) at her address? If so then the matching routines just mixed up and consolidated the addresses, happens all the time with junk mail--it just means they tried diligently to get it to you, and apparently it worked...

    My local dealer service writer actually told me about this upcoming settlement while having my oil changed. He told me I have "just enough" rust to fail inspection and would get a new frame if the settlement rules in our favor. FWIW, I bought my regular cab 4x4 last November, and a vehicle history report shows it spent most of its life in Ohio before coming to Florida, hence the rust.

    I got a recall postcard from my local Toyota dealer as well. Will be interesting to see what happens in a few months...

    Also, to keep on topic, I'm probably screwed. I got my frame coated and plugged. My truck came from Jersey. Which was surprising because the shop foreman (a friend of a friend) didn't even believe me and pulled the service records and goes, "Dude... This thing is cleaner than 90% of the trucks around here."

    So maybe I'll be alright. :notsure:

    If your frame fails the rust standard, they should replace it even if you have weld on sliders. If you run into a problem, call class counsel for help at 619-338-1100 and tell them you are calling about the Toyota case.
