    ^That is good advice and is probably the best route to cover yourself. At least then your own ins. co. will have investigated it.

    However, the work is already being done so that's out.

    best idea ever. i know a kid that every sunday when we were groing up around 9pm not late enough to suspect but no ones there anymore would go into the open ones.....if he couldnt steal them he'd take what he could get....i never had anything to do with this.........but its just an adaptaiton the smooth's idea

    "Go ahead and go through your insurance; what do you think will happen? They'll have it repaired just like the dealer." Uhhrugh? Then not only would you pay the deductable but thousands extra in increased premiums over the rest of your life....

    Best to take a multi faceted approach, get a laywer and file a consumer complaint with your states cosumer complaint department.

    The facts as stated are clear; while the OP's vehicle was on Toyota of Dallas property for repairs, in their custody, Toyota of Dallas is liable for damages incurred on his vehicle. The actions of employees which caused said damages means that Toyota of Dallas is also liable for those damages. The OP, having his vehicle now damaged, has incurred loss in the value of his vehicle due to the actions of the employees.

    This is cut and dry law. OP vs Toyota of Dallas (Defendant) It's nearly the same set of laws, at least as regards to property damage due to negligence, that would be applicable in a traffic accident. The traffic accident normally incurs medical expenses, loss of wages, loss of consortium, and a host of other expenses including legal fees.

    The "partner" has opted to "muscle" the OP into taking his "good nature deal" and may not be in the best interests of the OP. The "partner" doesn't believe or have purpose to believe the OP will go hire an attorney and sue over $XXXXX. Now, if the OP has incurred further damages due to the damages incurred, the OP has a legal right to be compensated for said or stated losses. That would include loss of value of his vehicle.

    This is a judgement call on the part of the OP in regards to what it is worth to him. An attorney could at least offer some weigh when attempting to convince Toyota of Dallas to restore the vehicle to it's previous undamaged state AND somehow compensating the OP for the loss of value incurred by the "repaired" but really damaged vehicle.

    I stand by my original post to keep this thread at the top to call attention to dealerships just plain taking advantage of people because they believe they can.

    Though the damage my already be repaired by now, a few thoughts for anyone in a similar situation in the future. Document damage with pictures and descriptions. Document names of all those responsible. File an "incident report" with the local police, informing them of what took place. (Unlike an accident report, this is official documentation of the incident which occurred). Get two estimates from where ever you choose to repair the damage. Present copies of the estimates to the responsible party, requesting payment. (1) have the vehicle repaired yourself and pay for it, then sue in small claims court, or (2) go through your insurance company providing them with a copy of the police incident report. The loss of value would have to be handled through an attorney.

    Why do many on here think that the OP's insurance company will pay to install new parts? The insurance company will do what is necessary to repair it. If it's minor damage, they will not pay to replace body panels. OP's best bet is to fight the dealer if he want's new parts.
