    Update 6/1
The good news is my insurance company is going to be making me an offer today on my truck. The bad news is they won't cover anything that was added to the vehicle unless it was maintenance within the last 6 months. They said any personal items will have to go through his insurance, which I understand and they should cover all of that. I am really pissed off about my suspension and other items I had put on this truck. That is thousands of dollars I am out. Not to mention they will never give me the money this truck is actually worth. It has a brand new frame on a 2006 with only 91,000 miles. Garage kept. You can't find that around here for under 20 grand.

This whole thing is unbelievable. Because of some drunk driver I lose the best truck I have ever owned and now won't have enough money to get another. My girlfriend and I are still here which is obviously the most important thing but I now can't afford to get the same truck that saved our lives.

I see you're from the valley. I'm originally from Allentown. where the hell did this happen? your insurance needs to sack up. don't accept those terms. you need to be compensated for all your shit. how do you "maintain" suspension. greasing balljoints? show them a receipt from your local oil change place or where you get your tires rotated. most likely they "looked" at it during their little bullshit walkthrough inspection checklist where they try to sell you extra stuff. the fact they "checked" it should be enough.

This was right by the Macarthur Rd. exit by the mall.

They mean maintenance parts I paid for. Such as tires, brakes, shocks etc.

I've mentioned it before. I'll mention it 1 more time. The drunks insurance needs to be paying the whole bill. What do they have to say about paying?

I tried arguing that once here and I was told to "get off my high horse." The penalties are way too light, and I'm glad someone else agrees.

Not sure why but my insurance is paying for my truck and his is paying for everything else. My insurance is going after his to pay for my truck, I guess.

Is there really a difference who pays? They will both pay about the same, right?

I have heard of situations where your insurance pays and goes after the other guys insurance to get reimbursed. Pesonally, I would never go for that. You now have a claim on YOUR insurance. This whole split settlement thing is really screwy. You need to start demanding like Kuato (SP?) did.

His insurance will pay for everything.Your insurance should only be helping in the process to cover what your whole truck is worth.Dont accept any offer that doesnt cover the whole truck.

Is it too late to switch this back to his insurance? I know I would have to wait another week. Is there any advantage to even doing that?

If you haven't accepted a payment yet it shouldn't be. The advantage is that his insurance is liable for EVERYTHING, including your lift and other accessories.

Okay, I might try to get it switched. I have not accepted anything yet and USAA told me they need a week to review all the property damage anyway. So I might as well have them do it.

I see what you mean. My insurance won't pay for my suspension because I didn't add it to my coverage. USAA is liable for everything, doesn't matter on my coverage with Liberty.

Find examples of comparable used trucks for sale in your area, and use those to show what the insurance company should be paying you.

Good luck with the recovery, immediately after my rollover I felt ok, but starting a few weeks later I had back pain and my upper back wasn't right for most of a year.

Typically insurance companies are slow to allow damage estimates, witness statements, and medical records to accumulate. They don;t like to start until they have them all so they can assess the whole claim. It's gonna take time but you will get a new truck. Your insurance company can help negotiate with them too.

Keep on it with doctor visits and stuff. If you spend $50 copay on doctor visit they actually should/will pay you back for $50 plus health insurance cost (full cost not what you pay your employer) typically $500 month. Add that to you GF medical and mileage and time off work to goto doc and your claim can add up quickly. Then when filing claim with them if they don't give you everything you want you potential for lawsuit action is 2-3x damages plus legal fees. So if they even start to play hardball just get a lawyer and give him/her cut and you will walk away better off.

You got a rental car already? Your insurance should help you there if possible then add to your claim for you and gf.

your insurance should only be used as a fall back if he didn't have insurance. What some companies do is pay you off and get you out of the picture and then go after more from theirs. Do not take a thing from yours if you can help it.

The bumper is ok! Make sure you get that back for your next Tacoma. Will make a good momento.

    Hope you are ok.
