Toyota won't perform a recall because my vehicle is modified

    Man, in California you can't renew your tags if your vehicle has an open recall. I had to get the blower fan recall done before California would let me renew my tags this year. I had the fan replaced but not under the recall...

    Now I don’t know about a Toyota...but when you align a millimeter wave radar on a Honda you have certain measurements...distance,height,and centering....all the measurements are for factory suspensions,,and factory wheels tires etc...Honda will flat tell you if it isn’t factory it can’t be aimed...because all the measurements are done and made from factory settings...using targets for static aiming..and on some static and dynamic aiming is required....if the vehicle is higher or lower than factory the radar isn’t reading properly...if the mmwave radar is mounted behind the grill is another issue...if you notice the new Honda’s that are mounted behind the grill..the radar is behind the H emblem..and the radar can read through it..if anything is mounted in front of the radar it can affect how it reads distance

    If they use targets, it can be aimed.
    They aim it AT the targets. That's the whole point lol.

    What they say and what the truth is, isn't always the same thing :)

    If you can't alter ride height then how does the system handle worn out tires? Weight in the rear? Or anything else that changes ride height and nose angle?

    TSS wouldn't matter, Toyota wasn't driving the truck. The driver should be paying attention and hitting the brakes not Toyota.

    In @hiPSI 's post, your right. Toyota gets away scott free with zero liability. (but they likely lose money on court/lawyer fees.)

    However, if the guy that got hit decided to name Toyota as another defendant, he'd likely be guaranteed a payday.

    Here's some armchair lawyer from someone who works in government and hears about the rediculous (allegedly) lawsuits we are forced to pay. A judge can (forgive me if different in certain jurisdictions) assign fault in percentages. Say the damages are awarded 99% the fault of the driver and 1% Toyota: also say it's a $2million claim. If the guy doesn't have enough money and can't pay, then Toyota is forced to pay the entire $2million

    Happens with government all the time. If a contractor does something stupid/illegal/cheaply and something happens, a lot of the time it's 99%/1% fault. But the damages are so high that the contractor just goes bankrupt and the state can't, so it settles or pays the full amount.

    So it's usually in the best interest of the person suing to name as many defendants as is reasonably possible.

    I think what happened in Canada is that the government told Toyota a recall would be forced if they did nothing, because the TSS system defect can cause uncommanded and inappropriate braking. What seems to have happened is that Toyota has made an argument to Transport Canada that the brake rate is sufficiently low that it will not cause a rear end collision. So it is a voluntary "service campaign" instead of a recall.

    I actually had my TSS system function confirmed by the dealer after I installed tires that raise the truck 13 mm (which is not a lot), because I did not want any insurance issues. When I showed up to do this recall, I asked them if they were just installing a boot over the sensor to prevent water ingress, or if there was reprogramming involved. They said there's reprogramming and they could not guarantee that the calibration would not be undone. They wanted $350 to redo it after the recall work. I asked for the keys back and applied some silicone when I got home.

    I would not even attempt to jump through that hoop out here in Comifornia. Toyota took the blower fan, they had installed 6 months earlier, out and put a new one in. Getting tags from California DMV is nightmare. I am telling you, don't think you are going to use common sense or logic to get by. They make it very difficult to register or renew an automobile. I had to get a friggin "weight certificate" for a 2006 Ford Ranger to verify the little truck didn't weight 10,000 pounds or more, I shit you not.
