    I wouldn't pick up anything yet. Picking it up could constitute acceptance on your part and nullify the lemon law qualifications

    Not my choice to make. I have to return the rental car before the allotted time frame otherwise they start charging my CC.
    Although this is important, so is my job and I need a vehicle to get to work.

    Disagree.

    Picking up the car doesn't constitute an end to the fight, or her giving up her rights. In CA, lemon law is pretty cut and dry, and her case has met the threshold.

    Can she leave the Tacoma at the dealership, and pay out of pocket for rental, due to her feeling unsafe using the truck? Sure.

    But the amount she would have to spend on the rental, she would have to go after Toyota at the time of settlement.

    I wouldn't sign anything without talking to a lawyer to verify you're in the clear. People here are not qualified to give legal advice. You might be worried about a few hundred dollars on your credit card but you might be taking a gamble worth 10s of thousands if picking up the truck signifies acceptance. Business law can be a tricky thing.

    Just spend hours reading up this whole thread.
    Geez! I wonder how long I'd have to wait before I'd get back my '16 tacoma back.
    It's already been 11 days and they've asked for 3 weeks.
    OP and I are in the same city and have same trucks too.
    Getting worried.. I've taken it back 3 times in the 3 wk's I've had it.

    Yes I know, but your very first post you stated that the low oil pressure/add oil light came on as you drove away from the dealer. They drained the oil........ Accidentally and lied to you. Did you include the fact the low oil/add oil light came on with strange engine noise to corperate?

    Yeah, like the people in the shop doing the oil changes know what intervals are on all the cars they do changes on. It makes perfect sense that they started to do her oil change, someone said not yet because it isn't at 10k after the oil was drained and they did not put any back in and then they lied about it after the light came on and then filled it and lied again and said it was just a little low.


    Fuck them hard with the lawyer and lemon law OP, just like they are trying to do to you.

    She sounds like she is getting frustrated by everyone's opinions on here. Just keep what you're doing op. I would do as your attorney says. I would also ask them though if there is any issue picking up your truck. My concern is that they are going to have you sign documents that may work against you in arbitration. This is pure speculation but ask your attorney since they actually do this for a living.

    Her accepting the truck back will do nothing negative in her lemon case. She is simply agreeing the work was performed on the vehicle, and she is accepting her vehicle back into her possession and giving the rental back. If she was to say she wasnt taking the car back, the dealership could actually charge her a storage fee for the vehicle being on their property after the work has been completed and her refusing to take back her property. They also could tow the vehicle from their property right to her driveway if she chose not to accept it back. The best thing for her to do, is get her truck back, and park it. Paying for a rental for a little while if she feels her truck is unsafe is the best idea and just park the truck while the case is resolved. Ive been through a Lemon buy back process, and these are necessary steps.

    She doesn't have an attorney. But if a business asked me to come pick up my truck after it has been there for a month I would be asking the attorney for their advice before I step foot on that dealership.

    You're right, we don't know all the facts. Which is EXACTLY why you aren't a qualified source to be "accepting" advice from. You aren't qualified, bottom line and you haven't provided any credentials to prove otherwise.

    Unless you were physically there and witnessing/watching the tech check the oil or otherwise of the vehicle in question, it could be deemed hearsay of SW potentially protecting the tech/himself/dealership.

    And thus has no bearing on this case. Service was performed by a qualified dealer, therefore, Toyota is responsible for it. Whether or not it actually occurred is irrelevant to the fact that the car was in for repair for more than 30 days.
    Plus, if they fully drained it, and it was empty, the oil light should have come on within seconds.

    What I gleaned from the discussion and her mention of the attorney is that they directed her to exhaust all avenues with Corporate before she seeks their services. Once the truck is made ready for pick up, services have been rendered and an attempt to resolve or cure the issue has been made. As "buyer" you're assuming some risk by accepting their offer. In some cases in business law this can constitute acceptance of services rendered. I'm not a lawyer, I'm not a Lemon Law Expert. I do have education and experience in business and contracting background and my advice to OP is that before stepping foot on dealership, signing any work orders, or accepting anything from them would be to verify with Lemon Law attorney that "picking up the truck" will not have any infraction upon the case she is building/has built. Saying it is OK, if you are not qualified to make that statement or provide that advice, is a foul. Suggesting she follow up with a qualified Lawyer for advice to mitigate a potential $35K+ disaster would be the safe move.
