in reference to this thread https://www.tacomaworld.com/threads...rbag-light-on-no-reason-update-4-2-18.523248/

My truck is going back to Toyota for the third time. My seatbelt and srs sensor in the passenger seat keep coming out of calibration causing lights to come on in the dash.

Now this time they are giving me a Tacoma to drive in the mean time instead of sticking me in a Camry or corolla like they have been. I think it's due to the fact that the trucks in for the same problem for the third time.

Has anyone had an issue like this at all? I love my truck but if this keeps on it's got me worried since now it's under warranty but what happens when this happens out of warranty? I had multiple people mention lemon law to me but this doesn't really seem like it fits or does it?

It doesn't matter if it's under warranty or not, going to the shop 3 times in a row, getting "fixed" 3 times in a row, all for the same problem falls under lemon law. You could declare lemon law and they would have to give you a vehicle of similar value or greater

They'll probably offer to buy it back before lemon lawing it.

    Good luck. Hopefully it's painless.

Remember, the dealer isn't going to delcare lemon law for you, you have to get a lawyer and tell Toyota/the car dealer that you are declaring lemon law

Since it's documented at Toyota and they are trying to fix the issue you will be ok. That's why it's important to get problems documented before warranty is out.

You do not have to lawyer up for lemon law. It's use, value or safety. Every state is different so look up. I was lemon law arbitrator for several years in Florida and the law is consumer friendly and has teeth

Not true. You just go in and say "I declare lemon law!"

Essentially the same way you declare bankruptcy.

It is true though? A family member of mine is going through lemon law right now

Interesting as I've always heard them term but thought it applied to major components like drive train and other major issues. I really do like my truck but I don't want this to arise in a few months or after warranty.

So if I declare lemon law they have to replace my vehicle with equal or greater value?

No. Not that simple. Google your state and lemon law. That will explain what you have to do.

When you register property with the state you no longer own it...your just a tenant. When you apply for a title ownership is split...you get the equity rights to the vehicle and all the liability to go with it and the government gets ownership. The question is Who would buy a vehicle that they don’t own? The answer is everybody because they sell the illusion of ownership thru word magic been that way since 1919! File a lawsuit in a court of competent jurisdiction as the equitable title holder to the property and enforce your rights under the lemon law. Of course arbitration is an option but that would be in the dealer best interest trying to get you to settle for less than what you would be entitled to under the lemon law. Every state is different so check your own...this is not legal advice so don’t take it that way!

Since this is for a safety device, I would think the dealership would really be sweating over this one. If someone were to get killed in an accident after the dealership screwed with it 3 times, they would be in a world of shit. It sounds like they are working with you so far, but if they start to push back, you can always play the safety card with them.

Nope, doesn't apply to major things. The battery in my aunt's car kept draining to empty when the car was off for just 3-4 days. The dealership "fixed" the problem but it kept coming back. It's happened 4 times in a row. It's definitely in the territory of lemon law

Ugh laws, taxes, and muddy ownership waters. I don’t know enough about these things, but I take offense to the “driving is a priveledge not a right” when I pay for the roads with 15 million different taxes. The amount of money suckled through my fragile teets in the form of registration and parking and titles and fuel etc I feel like I’ve crossed into the “right” territory.

Seriously my nipples are curiously tiny.
